ALL hopes for a "Lazarus act" harbored by congressmen seeking to resurrect the impeachment complaint against Pres. Gloria Macapagal-Arroyo were completely dashed when the House of Representatives, which resumed its regular session today, adjourned shortly after it convened for a lack of quorum.

With only 104 out of 236 House members responding to the roll call sought by majority leader Rep. Prospero Nograles, the presiding Speaker, Rep. Emilio Espinosa Jr., ordered the adjournment, denying any recourse by the pro-impeachment lawmakers of filing a motion for reconsideration of the plenary decision that, with a vote of 158-51 last September 6, junked all the impeachment complaints against Arroyo.

The pro-impeachment congressmen had hoped to exhaust one final legal option available to them only today at the Lower House — which the Supreme Court even pointed to when it dismissed late last week two petitions filed in connection with the Arroyo impeachment case. The petition filed by lawyer Ernesto Francisco was deemed premature as the pro-impeachment congressmen could still file a motion for reconsideration. The other petition filed by lawyer Oliver Lozano was dismissed for violating the rules of civil procedure as he already filed a motion for extension when he has yet to file a petition.

Raising the validity of the declaration of a lack of quorum, the opposition’s pleas, reminiscent of the justice committee hearings, were again conveniently ignored by the presiding Speaker.

Rep. Rolex Suplico asked how the quorum was computed, citing that many congressmen who were reported to be Arroyo’s travelling companions in her recent trip to New York to preside over the United Nations summit and general assembly, should not be counted as they cannot be compelled to attend and are not within the coercive power of the House, citing the Supreme Court ruling on Avelino v. Cuenco.

In that 1949 case, the deposed and replaced Senate President Jose Avelino questioned his successor’s title claiming that the latter had been elected without a quorum. Though it initially dismissed the petition,  the Court assumed jurisdiction and ruled on the existence of a quorum, declaring respondent Cuenco as the legally elected Senate President.

Suplico said the Supreme Court decision on the Avelino v. Cuenco case affirmed that the issue of a quorum can be applied only for House members who are within the country. 

It has also been the practice of the House, he said, not to declare those who are on official mission abroad as absent. House journals, in fact, list them among members who were present during sessions, their status — whether on official foreign or local trip — noted by the use of asterisks.

Akbayan Rep. Loretta Ann Rosales, who was able to obtain a list of the 31 congressmen who are on "official mission abroad", also insisted that the correct way of computing the quorum is to exclude those on the list from the roll.

On the said list were the following representatives:

Of these, eight have already returned — Baculio, Velarde, Magsaysay (Eulogio), del Mar, Jalosjos, Tulagan, Pichay and Espino. Pingoy is on a local mission while South Cotabato Rep. Darlene Antonino-Custodio was erroneously listed as abroad.

Even with only 22 "on official mission", Rosales said that adding this to the number of House members present would add up to 126, well within the needed quorum of 119 to conduct House business.   

"By hastily calling the roll and declaring a lack of quorum, this only added to the malice and the cloud of doubt that attended the impeachment process," Rosales said, lamenting the majority’s continuing "obstruction of justice."

On the motion of Nograles, the roll was called at 4:30 p.m., earlier than the standard practice slated at 5 p.m. on session days scheduled on Mondays to allow time for members, especially those coming in from the provinces.

In the abovementioned list, only Reps. Umali (Nueva Ecija) and Cuenco (Cebu) were reported to have joined Arroyo in the U.N. trip. Others mentioned include:

As the impeachment complaints were finally declared dead, Mrs. Arroyo asked the opposition: “Which God do they pray to?”

A congressman, whom the Tribune asked to comment on the God statement but who also asked for anonymity, cracked, saying the pro-impeachment congressmen pray to the “right God, but since God does not interfere in politics, Gloria’s God, named Mammon, was very effective in killing the impeachment complaints.”

This cheat is not afraid to claim that the God is supporting her. surely, she will continue to claim this until her end. Because she is too disilusioned about her fake power.

Honestly now, did someone really expected a quorum yesterday? Well count me out… i never in my wildest dream thought that there will be one, with Tongressman like Nograles, Libanan, Lagman, Datumanong, Villafuerte & the leader of the band…..Energizer buddy…. JDV in the House, ….GMA, the PEKENG PANGULO that she is …..can never go wrong. What was surprising was there were more than 51 present i really thought that i will only see 51 respectable, distinguised and NOT FOR SALE Congressman & Congresswoman in the House yesterday.

Wala na talagamg kahihiyan na natitira sa katawan yang kongreso na yan. Sasabihin nila na move on, ‘di ba dapat yung pag-move on ay kusangloob. ‘Di yan pilit na isinasaksak sa bibig. As long as this congress acts as they are the masters of the world, tuloy-tuloy and political unrest dito sa’tin.

Kelan ba naman nagkaroon ng quorum siyan sa congress, ‘di ba nga sabi ni Cayetano, nung botohan lang sa impeachment meron qourum. Eto pa ang siste, sinisi pa ng mga yan na kaya walang matapos na bill ay dahil sa impeachment. Sino niloloko niyo? Kaya walang matapos na trabaho ay dahil lagi nalang walang quorum. I hope the PCIJ will investigate kung pumapasok nga talaga yang mga congressmen na yan. Yung palaging absent, dapat ‘wag na pa-suweldohin at tanggalan ng ‘pork’ para madala at magtrabaho.

Absenteeism seems to be a norm for the members of the Lower House, more specially, if there is something important to be taken-up in the plenary, like in this case : the motion for reconsideration (MR) of the plenary decision junking all the impeachment complaints against gloria.

My unsolicited advice to my goodfriend, Rolex, why not bring the issue on quorum to the highest tribunal?

Why not? Who knows we could have a fresh whiff of judicial legislation in the offing.

We all knew from the very beginning that the pro-impeachment Congressmen’s desire to resurrect the impeachment complaint against the squatter of Malacanan was not going to prosper. Her allies in Congress will block and play games over and over again just to protect the fake president and her bogus administration. Hindi naman sa ordinaryong mamamayang pilipino ang loyalty ng ibang mga Congressmen na ito Wala naman kasi silang makukuha sa atin. We have no millions to pay them off. Kahit na nga sa U.N ay bitbit pa sila ni Mrs. Arroyo para may pumalakpak sa kanya. Mahal ang bawat palakpak na ‘yon. Sabagay, hindi naman sariling pera ni Mrs. Arroyo ang ginamit, sa taong bayan naman. Kawawa naman ang mga Pilipino.

I saw a little bit of her interview with Max Soliven. I can’t stand her especially when she smiles. It is so damn fake just like her fake presidency. Before the “Hello-Garci” scandal, Mrs. Arroyo was known to have a very bad temper and was a snob. But now, all of a sudden, she’s all smiles. What a joke! No matter how they try to soften her image, it’s too late for that. I don’t think it’s easy for a person who’s a bitch to change overnight.

The only reason why Mrs. Arroyo is still in power in spite of her very fragile administration is because she made concessions to everybody (Congressmen, Military and etc). Her latest one is promoting General Bagasin to be the deputy chief of staff. After the flak she got with her another “lapse of judgment”, she has to appease him and the military. Poor Mrs. Arroyo!

perhaps God is still undecided as to who He will choose to take over Gloria. God knows the people have suffered enough and He wants to make sure the one He chooses must be the rightful leader. If it is taking God so long to decide don’t you think that perhaps there is no one yet He could find that is worthy of His trust?

Pro impeachment congressmen should not waiver in their quest for truth i.e. ousting GMA. I agree with indio that they should bring the issue of quorum to the Supreme Court. Also, Atty. Francisco et. al. should now refile their petitions on the ground that by adjourning yesterday’s (last day for filing motion for reconsideration of the house resolution) plenary session, all remedies in the impeachment house has already been exhausted. We need to to be enlightened by the highest court on whether the amended complaint effectively falls under the one-year-bar rule or whether such is just a bill of particulars as opined by constitutional law expert Father Bernas.

They can go to the Supreme Court and it may declare a favorable ruling for the opposition re quorom issue. So it may re-file for reconsideration again. But who woulld stop the honorable representatives from absenting themselves again when offered the right kind of incentive just to mess up the quorom? And who from the administration would have the balls to reverse himself, again when offered the right kind of incentive, with a little scaring for guaranteed effect? Give it up, guys! Submit the issue to the real souvereign because it is their call now.

The Caving Roof

There seems a thing of people not able to adequately connect to why in our decades of existence as a free nation, following independence that is, matters of finding ourselves amid confusing I.D. problems continue to dog us even more, we can’t know who we are really, whilst it be our forced self-exile anywhere sans economic despondency, our aim doesn’t really matter, earn something and be anywhere, I call it the ‘Jeepney syndrome’ or doctors studying to be nurses?

Are we asking, basking in hew of ivy something of toxin, why the Jeepney? Why not ask me why grandma have always been amongst the kind that says good old days, good old days, but what about what grandma knew?

Grandma who took ward of me since I was toddler of two, says she missed the ‘Trambia’ a feature transport of once regal Manila during the 30’s, clean transport means unlike anything that’s new, not even the Jeepney, the poison spew, the daily dose of death stew for Pinoys. She was a senator’s wife during the Philippine Commonwealth, and a Muslim that’s why I believed her.

The Trambia resembled the San Francisco fabled cable car racing up and down the streets of San Francisco, USA, a feature never to be removed from minds of many Americans and much of the world like the Pinoy with the Jeepney, because it somehow describe a way of life that is definitely clean; unlike the Jeepney that is everything but, really dirty and a danger at every given curb. Would this be the prescription or the description why we are oh so late for work? Late to develop unable to breath well like everyday is a gas attack spewing to scatter poison to soil the air, every curve a death mark; this is the Jeepney syndrome, why are we so backward not realizing it is suicidal having the Jeepney around much too much?

This brings to mind why our legislators have always been so hamstrung over issues especially media prone issues, the decadent media hype on any issue can by some large extent make or in certain cases, unmake politicians. Like the Jeepney, a sort of a quick temporary transport means after the huge 2nd World War, I am certain there will be other noises in the future as had the past, the temporal grandstanding by any emotion griped politician, rightly or wrongly.

But kicking ass remove somebody big indeed can be a celebrated media event, can make congressmen senators or perhaps even be president one day, a Jeepney King persona once made it big, made it becoming president, and why not? It does pay well to be president in this country.

I have serious doubts whether by our having become so engrossed with issues we forget to be people in need of government that can be answerable; a government to respond to our exclusionary need not one to cater to an outsider’s greed who would have none to spare anyway, after all what is there to spare?

Nothing significant to ask except be part of an effort to be at war or be part of a determined effort to be removed away from conflicts, is this the overriding tune or the overburdening global disease called terror? Well then, let us confuse more and or choose our graveyard, or make crucial choices find us a government, not of an alter persona to make us a government I certainly hope to God it is not a person replacement!

But what if we are the kind that would like to live in peace, live in real prosperity? Would it be to mean it is crazy to be asking for the moon, I believe ours have had much of the sun, scorched our well being basking to forget we have problems that could be the trigger to doom, or be rigged into something we can’t know, should we call it war and us wanting peace and prosperity, warriors?

Nothing is new, it is a rehash of things, a make or break transition to nowhere like the nomad shepherd with no sheep to tend, only garbage and dumps to dwarf the Everest to sift through so to eke something for something, no nothing is new, only heartaches and being so downtrodden poor and really hungry.

But what if we are the ones not taking heartaches, warriors of worth because we happen to love our kids, not die but live for them, and why not? And no guns needed or bladed weapons, true freedom like Mandela!

What if we are so knowing of something to end wars and famine and you guys out there happen to share the same enthusiasm and be the warriors, a differing breed of warriors who would like to live because we love our kids?

What if?

But like the magical wand that brimmed to shoo away a dictator once, deceive not for it was the Merlin Man not the wand that brought to heed that crushed the chary vainly Iron Man, but the Merlin Man lived no more he is a goner, dead! We must then remind the smothered fairy t’ is not her wand that did the magic, I insist! The Merlin man smothered of God has passed, never to resurrect. Let the Merlin Man be in peace, let us have peace for God’s sake!

Or must we? Aye, resurrect the dead so evil may leave our midst, depart not be cumbersome again and again evil mother of all evil, in vales of tapes to sample of unwitting lies? Sample the stench from the carcass of war; children denied of shelter and food, orphans and widows, tapes you say? Nay, Mesdames, it is war I meant…must or mustn’t we end them?

What if we push for regional interests under a unicameral legislative body but with a senate to be representing regions instead to work under a Federal System of governance, will this keep the senators jump with glee? Well, not really but the least is frown with something, they always have something very deep in meaning but less of substance unless quadruple their power pork will there be good, God forbidding results? Yahoo my ass!

But grandma has more of stories, tales of wit of what was the ‘Peace Time’ good old days says she is driven in paved roads by a car among three or four in Mindanao, democracy yet in infancy made more lawyers, doctors and nurses, peace not of any other kind but among peers in battlefields that raged of bravery, of courage real war fought by real men that decided then peace is a better war to wage, and they did and succeeded. This was the 9/11 draconian man in the 20’s, now once more in decadent rage over an insanity driven present-day war by a deranged self-proclaimed messiah, the doomsday man.

Communication was the problem then, in the 20’s or thereabout shiploads of teachers shipped in from America bridged up the gap, in few commanding years everyone learned the ropes why communication is quite of importance, like scratch mine and I can with yours sort of simple exchanges? Simple but it stopped a raging war.

Because of the ‘Peace Time’ her husband made it to the senate during the Commonwealth, a son becoming a senator another son and a daughter governors, so peace time is the one piece of treasure I will relish if only to keep memories of my departed grandma’s good old days, good old days anyone?

when i heard the news about this ‘lack of quorum’ in congress.. tama, what else is new?..

alam ng mga ‘aso’ na yan na SOONER OR LATER THEY WILL BE GONE… kaya ung borrowed extended time nila ngaun ay gagamitin nila to get everything they can, specially resources (money, etc)… para once n maalis n sila, punta lang silang ibang bansa and that’s it… buhay hari n sila dun. now can you imagine kung ano mangyayari sa ‘pinas while they are consuning that ‘borrowed time’?… lalong gagapang ang ‘pinas… habang sinisipsip ni GMA and her dogs ang MAHAL NATING PILIPINAS…

alam ko may mga nagbabasa nito n mga mata ni Gloria… makunsensya naman kayo please… maawa naman kayo sa bansa na kalalakihan ng mga anak nyo…

dati, i hate guys like dinky soliman, etc… kasi sabi ko maski nasan si gloria, nandun sya… un pala ginagamit lang sya ni gloria… kasi DSWD is the best agency to be ‘near’ the people specially the poor… pero ngaung umamin n si soliman about sa kabulukan ni gloria, please naman.. sana ung mga gusto n syang gayahin… stand for your principles… for your country…

i guess, that was one major blunder for Erap when he was the President and Gloria was the VP.. He put GMA to DSWD kya ayun si gloria punta ng punta sa mga tao.. nangangampanya.

again, i cant help but shake my head everytime i hear these kind of things in the news there… ang kapal ng mukha ni villafuerte sa congress!… ang tigas ng mukha mo villafuerte! alam n alam n ng lahat ang baho mo pero nakukuha mo pang ipagtanggol si gloria!…

pero sabi nga. ‘weather-weather lang yaan”….. mag-subi n kayo.. hehehe 😉

MAJORITY RULES. This is the bedrock of democracy. It is the foundation of a strong democracy when the majority of HONEST and CONSCIENTIOUS men bind themselves together for the common good of the greater majority. What we continue to witness today in the Senate and the House is simply a majority of men who bind themselves together for a common devilish purpose. This is a betrayal of trust and defy the principles of democracy. This must end.

The Constitution will be rewritten soon. This is an important issue that the constitutionalists must be prepared to rectify because the country and its people should never be held at the mercy of and captive by an unscrupulous ruling majority. Bringing the issue to the Supreme Court may be fruitless as it cannot be expected to interfere in matters purely the internal affairs of its co-equal body. It behooves, therefore, the constitutionalists to resolve this problem and put an end to the abuses of dominant party system. This is but one of the political changes the country badly needs to reform the political system of governance.

The other equally important is the fight against corruption in government. Bring down the minimum Plunder amount of P50 million to any substantive form of corruption and classify it as high crime against the people.

I beg your pardon MenOK, maki butt in nga. This is not to defend the pro-GMAs, I too do not subscribe to everything GMA says, but I believe the pro-GMAs have the right to express their opinion, just like all of us
in this forum do, and that includes you. We have to admit that we all have our biases, likes and dislikes, anger and hatred, but let’s all keep
the discussion clean, freely smooth, and defend what you believe in without putting malice or saying harsh words to anyone. Thank you.

Alam mo nahawa ka na sa style ni GMA and her ‘dogs’… YOU ARE TRYING TO DIVERT TO OTHER ISSUES… INIIBA NYO… ngaun sinasabi mo kung anu-ano n naman.. nilalayo nyo na naman.. the point is NANDAYA AT NANGLOLOKO SI GLORIA!… YUN ANG SAGUTIN NYO AT DUON KAYO MAG-FOCUS SA ARGUMENT NA YUN!.. HINDI UNG NILALAYO NYO!… ngaun, ni-relieve naman ung Police chief sa makati.. kasi raw over-staying.. 5 years n raw kasi at dapat two years lang sa post.. kung two years lang bakit hindi sya nilipat on his third and fourth year… bakit kung kailan mag-aanim na taon na at sa kasagsagan ng mga rallies sa makati tsaka nilipat?!…PLEASE, YUNG MGA TAO SA ADMINISTRASYON AT YUNG MGA PILIT NA BINIBIGYAN NG KATWIRAN LAHAT NG GINAGAWA NG GOBYERNO, HINDI KAMI TANGA!!!!!

Ung mga police ngaun, preemtive measures na ipapatupad, hindi na maximum tolerance… ibig sabihin maski hindi pa nkakapag-rally pwede ng buwagin ang mga nagtitipon… tapos hindi raw marshall law?…. PLEASE!!!! KUNG SA TINGIN NYO MGA TANGA MGA TAO, BAHALA KAYO.. PERO TANDAAN NYO.. ANG PILIPINO MENTRAS INAAPI, LALONG NAGAGALIT!…
