IN an interview with cable channel ANC this afternoon, Justice Secretary Raul Gonzalez said that the government is monitoring the Philippine Center for Investigative Journalism (PCIJ) because some of the postings on this blog are inciting to sedition.

"We have been monitoring this," he said, "it is very clear, they have been posting in their website many things I consider as inciting to sedition. We are studying them."

Gonzalez specifically cited the three-hour recording of the allegedly wiretapped conversations of former elections commissioner Virgilio Garcillano. "The fact that it [the PCIJ] kept posting the matter of the Garci tapes is violative of [Republic Act] 4200 (the anti-wiretapping law)," the justice secretary  said.

He also told news anchors Ricky Carandang and Pinky Webb of the noontime news program, "Dateline Philippines," that he was not aware of the charges being supposedly prepared by the police and sound engineer Jonathan Tiongco against PCIJ. "It has not been cleared with me," he said.

The justice secretary, however, revealed that he has a list of people against whom charges may be filed. "I have a number of people on my list. I also consider, counter-check with other lists. We can’t go headhunting. We have to find out if the basis is enough."

Here is a transcript of an excerpt from the ANC interview with Raul Gonzalez:

Q: Mike Defensor said that he will reveal a list of those who will be charged.

A: I don’t think that should be revealed. It should come out as charges are being filed, but to announce that a list of 100 people as suspects, you tell them to go into hiding.

Q: Is there a list?

A: I have a list. I don’t believe my list is as large as military intelligence. 

Q: How long is your list?

A: I have a number of people in my list. I also try to consider, counter-check with other lists. We can’t go headhunting. We have to find out if our basis is enough.

Q: Are there people from the media being investigated? The five from PCIJ?

A: I don’t know anything about PCIJ, it has not been cleared with me, I don’t know.

Q: What about Tiongco’s action?

A: Most likely because it never passed my desk.

Q: Are those five from the PCIJ included in your monitoring?

A: We have been monitoring this. It is very clear. They have been posting in their website many things I consider as inciting to sedition. We are studying them.

Q: Are they part of your list?

A: Yes

Q: Tiongco has nothing to do…

A: I don’t know anything about what Tiongco is doing. He hasn’t talked to me.

Q: Is he a credible witness?

A: It depends on the evidence he will talk about. If he talks about the tapes, it does not matter whether his reputation is no good.

Q: Sheila Coronel of PCIJ, during yesterday’s hearing showed copies of IDs that she said showed Tiongo is an intelligence agent of the PNP. Are you aware of this?

A: I don’t know.

Q: Is it possible?

A: It is a possibility, it is possible the police, PDEA, they have assets. NBI has assets. This doesn’t mean they are in the payroll.

Q: Tiongco’s actions are his own?

A: I think so.

Q: You said that the PCIJ postings were inciting to sedition?

A: Some of them. The fact that it kept posting the matters in the Garci tapes is violative of 4200.

Q: Charges may be brought against them?

A: I will not answer that for the moment.

Q: At least it’s clear now they are part of your list?

A: Yes

The president you serve who appointed you is a fake president. She does not have a mandate. She manufactured one. Through the stellar efforts of Garci, Gen. Jun Esperon, Gen. Habacon, and other cheaters out there.

I don’t believe that believing GMA lied, cheated and stole is inciting to sedition. So is being vocal about this belief. So is expressing oneself that GMA must resign if she has still even a single strand of moral fiber in her system.

Ginagamit mo ang pera ng taong bayan para manatili sa pwesto na hindi naman sa yo. Usurper. Mahiya ka naman.

Serving a fake president who does not have the mandate from the people is treachery. You and your company should be the one charged with treason for being enforcers of GMA’s illegitimate rule.

GMA, call a snap election now to end all these uncertainties and moral ascendancy issues. Alam mo ang totoo kung paano ka napunta dyan. Tama na ang pagkukunwari. It’s you who is “incorrigible”.

Pero bago niyo kasuhan ang PCIJ,puwedeng unahin niyo muna kasuhan si Gloria in the Palace? Siya kasi ang principal sa crimena inciting to sedition. Without her actions, di naman siguro magpa-publish ang PCIJ at iba pang bloggers at mediamen ng mga articles na nag-i-incite nga to sedition.

I must admit, many of the posts in my blog can be considered “inciting to sedition” since i’ve extensively discussed the illegitimacy and pidal/corruption issues of this so called president.

and although i have never called for violence or a coup to oust GMA, i admit that i have called for her resignation and even called for her removal via people power.

if exposing this crooked and illegitimate president is “destabilization”, then i’m a “destabilizer” too.

Recall if you will how we got to this point. in 2000 PCIJ came out with numerous reports on Erap, his midnight activities, his mistresses, his families and his real estate investments.

Those reports sparked a lot of public outrage, Chavit’s betrayal of his friend, an impeachment and then EDSA 2. IMO lang naman…nauna ang PCIJ reports…yun sa tingin ko ang naging motivation ng karamihan to form a negative opinion of Erap and eventually join protests at EDSA 2. It was for me anyway.

Knowing what transpired in the past, what do we expect this administration to do with PCIJ? Do you think it’s illegal of government to conduct an investigation? Hindi naman illegal yun per se. “We are studying them” ang sabi nila….Tinaasan kayo ng kilay. Don’t overreact.

Cool lang…have any cases been filed?

I don’t think Sec. Gonzales has any case if he proceeds with his threats and that is all it is, threats, intimidations and what do you expect from a hatchet man? Sedition is directly aiding anybody or group of people to overthrow a duly constituted govt. by unlawful, or unstitutional means and publishing any evidence of wrongdoings by government official don’t fall under the category and if the Secretary believe the publications were not factual then he may proceed with charges of libel. Sedition .. now you ruin my holiday..

You are completely missing the point. The fact that the Justice Secretary is airing his opinion that the PCIJ is seditious constitutes a THREAT in itself! You are assuming that Sec. Gonzales and his bosses are righteous–that they will stick to the law, when evidence shows they are out to persecute their critics. Hihintayin pa ba nating may makulong bago tayo umangal? By then it will be too late.

maski media hindi above the law. yun ang punto. if there have been laws that have been violated, let them sue. nothing has come of this so far…nothing…no charges brought forth. is that true or not?
if someone is going to say hindi rin above the law ang government or si GMA – then go after them too. but we have to follow LAWS and not let our emotions take over serious matters like these. we did that before and that’s why we are stuck in this vicious cycle our great-grandchildren will inherit. We all get emotional and we make the wrong decisions – decisions based purely on emotions. We’re not under a dictatorship – I know the difference cause I lived through martial law. Hindi na justifiable ang guerilla tactics.
Gonzales has shot off in the past so many times, I’m not speaking for him pero tingin ko monumental blunder na naman nya to…and is his personal opinion – “I CONSIDER” is what he’s quoted as saying. As justice secretary he should be more careful what he says. IMO, he’s not helping and he’s also a damned fool who causes more trouble than anyone in this administration and am surprised he’s still around. How anyone will interpret his words is up to them.
Which do you prefer – to know what this administration is thinking or planning to do rather than have them come in the middle of the night and start picking up people and closing down media outfits?

Why should I assume someone is not righteous when I don’t know them? why would i presume evil of my fellowman? It would be presumptious of me to think that. IMO, our individual expectations of others have a way of become self-fulfilling. Besides, I still strongly belief in the Golden Rule, “Do unto others as you want done unto you.”

inang bayan.

Hindi ako abugado, pero, gut feel ko, all these insinuations and/or accusations against the PCIJ will not prosper, i. e., kung hindi sasalaulain ang batas.

We keep on protesting on an impeding Martial Law.. but I think we are calling for it.. Martial Law can never happen if we give no reason to have to.. Since we are so afraid of GMA, removing her may lead to martial law.. at least 1000 days under the Transition Government.. (Under the control of the FEW) parang martial law din ata papunpuntahan natin…

kaya mag work nalang kau.. wag magpapagamit dahil siguradung hindi naman kau mapapala.. .. ilalagay nyo lang sa komunista ang pilipinas…

The Philippine government now wants to extend its claws even into Cyberspace In a representative democracy, the government is supposed to be “of the people, by the people and for the people.” The leaders are elected by the people. If the leaders do their job well, they get re-elected and if not, they lose. The only way for the people to know if the leaders are doing their job well or not is through the mass media. Mass media’s role, therefore, is very crucial in representative democracies. Thus, the US Constitution’s First Amendment prohibits any laws “abridging the freedom of the press.” The Philippine Constitution of 1986 has a similar provision. Article III of the Constitution presents the Bill of Rights, namely: Section 1. No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. Section 2. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized. Section 3. (1) The privacy of communication and correspondence shall be inviolable except upon lawful order of the court, or when public safety or order requires otherwise, as prescribed by law… Section 4. No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances. The framers of the Constitution made sure that the English construction is very simple so there would be no mis-interpretations. Yet it seems that the country’s government and/or police force do not understand these simple words. The freedom to peaceably assemble is practically gone now through the implementation of the “no permit no rally” rule. The right to assemble and the right to express one’s grievances are basic in any democratic society. The government, since PP1017, continues to warn media to follow government guidelines or else risk takeover. The office of one newspaper was raided and was about to be taken over if not for the resistance put up by its feisty publisher and the howls of protests from media people. And now even the bloggers must beware or else Mr. Justice Secretary will call on the police to arrest these rabble rousers. […]

Paulit-ulit ko pong sinasabi sa pondahan ni Indang Vireng ang pagbabago ay magsisimula sa taas at susunod sa pagbabago pa ibaba hanggang sa grass roots. The goverment will initiate, the govern will follow. Lalo na po ang masa parang herds of cow yan kung saan ang ulo doon sila tatakbo. Kaya po kayong lider natin nasa inyo ang poder mag bago na kayo. Ito naman si Ka Raul Gonzales.. Sus!! maryosep!! akala ko pa naman makatao ka e natuntong ka sa likod ng kalabaw naging Herodes ka na. Paano mababago ang bayan natin ka Raul?

I considered Jonathan Tiongko if not the best, one of the best Disc-Jockeys here in the Philippines… but there is something wrong with this guy, in regards to his behaviour. Mejo warfreak yan & a certfied user… di ba credibility of a person is at stake in things like this (Garci controversy)?,

“I don’t know anything about PCIJ, it has not been cleared with me, I don’t know.” – Gonzalez in the Interview

How could he accuse the PCIJ for these things, when he doesn’t even know anything about the PCIJ? What activities is this man referring to? Postings by people? Well, this is the Internet, and he DOES NOT have a right to control it (which may be a possible consequence of the postings).

In addition, if what the PCIJ is doing is “inciting to sedition” in the Gonzalez case, would the same case apply to everyone who does similar activities? If this was the case, wouldn’t all of us be “inciting to sedition”? In that case, Gonzalez himself is a very ignorant person for failing to realize these things!
