‘The puzzle fits’

BELOW is the statement of the Legal Team (Amended Impeachment Complaint) headed by U.P. College of Law Prof. H. Harry Roque Jr. on the recent revelation made by former social welfare secretary Dinky Soliman on the circumstances surrounding the impeachment complaint filed by Atty. Oliver Lozano and endorsed by Alagad party-list Rep. Rodante Marcoleta.

The Puzzle Fits

The revelation by former DSWD Secretary Dinky Soliman on how the Marcoleta-endorsed Lozano complaint came about illustrates yet President Gloria Macapagal-Arroyo’s propensity to trivialize constitutional processes such as the impeachment.

It appears that from the very onset, Malacañang has had a master plan to defeat all constitutional means by which to hold the President liable for her acts of cheating, lying and stealing.

It also explains the political play that we have been witnessing in Congress since hearings on the impeachment complaints commenced in the House: by causing the endorsement of the Lozano complaint that was patently insufficient in form and substance, the President would be assured of yet another impeachment free year in office given the one impeachment proceeding per year rule.

No wonder the pro-GMA legislators will almost certainly insist that the House Justice Committee should hear only the original Lozano complaint.

But despite Malacañang’s grand design, they apparently did not foresee even the possibility of the filing of the Amended Complaint which would detail the Presidents acts of cheating, lying and stealing.

While a second complaint may have been within their contemplation, an amended one, which in legal parlance would supersede the first complaint, was not. And certainly, they did not foresee that no less than insiders, the Hyatt 10 today, will bear testimony as to how the President clearly committed yet another instance of obstruction of justice. Clearly, while the Palace was not wanting in planning and conspiracies, they did not succeed in its grand plan to conceal the truth.

The legal team of the amended impeachment complaint now calls on both the members of the House of Representatives and the general public not to allow the President to succeed in her obvious design to make a mockery of processes enshrined in the fundamental law of the land, if only to retain her stranglehold on power.

We call on the members of Congress not to contribute further to the emasculation of Congress as a democratic institution and transmit forthwith the Amended Complaint to the Senate so that the truth may finally be known. To the sovereign people, we ask you to let your Representatives know that their participation in this conspiracy to corrupt constitutional processes will certainly meet not only your ire, but also a guilty verdict from history.

please please remember the names of the congressmen who participated in making a mockery of the impeachment process, campaign strongly against them, let them know your sentiments and anger in their participation in this MORO-MORO of an impeachment proceeding. I had my misgiving when the minority decided to file the impeachment complaint that it will just be a waste of time kasi talaga lotong makaw ito, but I was willing to give our congressmen/women a chance to prove that they are men and women of principle that they will decide base on substance. How wrong I was, these men and women donot deserve to be called honorable but rather DISHONORABLE they dont care about the country they only care about their pockets, PERA PERA lang pala ang impeachment. Suggestion if you see these men and women member of congress enter any public places like restaurant maybe you can start tapping your glass with fork as a sign of protest.

The last card of the opposition now is the magic 79 signatures. If they can muster it in time for the plenary vote, then “tuloy na ang litis sa Senado”.

If not, then we will have no other recourse but to “shut up or put up”. To put up means is to exhaust all means – legal or illegal to remove an illegitimate president.

It is not a destabilizing move to remove an illegal president but a stabilizing one. The moment that she had occupied the office by illegal means is a reason for us to remove her at all cost. As the constitution says, all power emanates from the people and sovereignty resides in the people. Thus, it is our mandate and duty to remove a bogus president.

ha ha! We will show the world that we don’t tolerate “corrupt” presidents like her. Yet we’ve for the last 20 years showed the world that we elected AND tolerated hundreds of other inept, immoral, and greedy politicians into. In fact, we elected the top moron (Erap) to office back a few years ago! 😀

Removing any government official by Fiesta Revolution will simply “show the world” what a shortsighted, tunnel-visioned people we are.

Oh please…this is politics we’re talking about. If the opposition filed their own complaint before Lozano, we won’t even be discussing this. Tuly-tuloy na yung impeachment. They were beat to the punch by Lozano and that’s that. There are rules and laws that should be followed in an impeachment. It’s no joke so dapat plantsado at plina-plano lahat. Politics is won by the wiliest players. This is democracy, the democracy we went to the streets to gain. We have a responsibility, just as the opposition, to be more vigilant to safeguard that democracy. And this is it…AS GOOD AS IT GETS.

As for Dinky, what she’s saying is her perception of GMA’s intention. Perception/intention – hindi mo puedeng dalhin sa korte yan. Parang beauty – it’s in the eye of the beholder. That will not fly. Magdugtong-dugtong na lang tayo ng kwento. This is not a game, this is our country.

If there’s anyone to blame for this so called “travesty of justice” in the House of Representatives its the opposition. Their very ineptness in dealing with the impeachment complaint is beyond stupidity. Their so called “amended complaint” appears more like a “second complaint” which is a no-no under the law considering that it tantamounts to double jeopardy (who were they trying to fool?)…the fact that they couldn’t muster the required signatures until now proves that there really is no concrete basis for impeachment. Don’t get me wrong, I’m not a big fan of President Arroyo. But to say that the opposition was defeated in its impeachment complaint because the whole proceeding was railroaded by the administration is a big lie. Why were the congressmen able to impeach former president Joseph Estrada considering that he has more loyalists in congress than GMA? Let’s face it —- not many congressmen believe in their impeachment complaint.

Totoo pulitika to… pero Mita MS, may mali po ata sa argumento nyo. You are prescinding from the premise that somehow, dahil sa pag-file ng complaint ni Lozano, the complaint filed by the opposition is useless… hindi po ganun yun eh.

Any law student na naka-take ng Constitutional Law I should be able to tell you that nothing in the rules of impeachment or more importantly, the decision in the Francisco Jr. case (yung impeachment case against Davide), should bar the impeachment proceedings…

Ang basic difference nung Davide case ay ganito: doon, may naunang complaint na finile sa Committee on Justice, and after it was dismissed for not being sufficient, another complaint was filed with the Committee. Malinaw dun na yung 2nd complaint would be barred by the one-year rule.

Dun sa impeachment ngayon, we are talking about three separate complaints that were filed with the Committee on Justice at more or less the same time. And since they allege basically the same thing, which is betrayal of public trust, then there is nothing which disallows the filing of the three complaints together as one consolidated or amended complaint… In other words, hindi pa na-trigger yung one-year rule at the time that the opposition filed their own complaint…

So see, ang problema dito eh hindi yung rules (i.e., that Lozano beat them to the punch will not fly either…) Ang problema talaga dito ay yung mga pulitiko at congressmen na: 1) bobo talaga at hindi maintindihan ang batas at jurisprudence; 2) nagtatanga-tangahan at ayaw intindihin ang batas at jurisprudence for whatever reason; at 3) sobrang talino pero twisted and kunsensiya kaya pilit na iniiba ang ibig sabihin ng batas at jurisprudence, dahil marami umaasa sila sa mga Pilipino na: a) katulad nila; b) nabibilang din sa (1) and (2) sa itaas; o c)wala nang pakialam, o 3) do not know any better…

Kung nais niyo po ng mas credible na source tungkol dito, may article po si Fr. Bernas… i can provide you the link if you so request. Besides, I’m really not good at explaining these legal provisions…

Anyway, I hope this helps clarify some things….

malinaw pa sa crystal ang paliwanag mo manunga. iniiba lang nitong mga alipores ni arroyo ang interpretation ng batas. kahit hinde ako abogado o kahit grade school ay maiintindihan ang difference ng complaint sa proceeding. sabi sa batas pwede ka magdemanda or mag ameinda(complaint/amended compaint) ng reklamo sa isang proceeding within a year. o di ba kalinaw na isang proceeding lamang na may mga reklamo ang kasalukuyang dinidinig sa kongreso? tingin ko nga non existent ang lozano & lopez complaint dahil sabi ni arnulfo fuentebella ay hinde verified. dito pa lang ay bagsak na sa debate mga majority tongressmen ayaw lang pakinggan ni datumanong kasi talo sila sa deliberations. hinde rule of law ang labanan rule of numbers na kahit mali ay tinatama dahil sa padamihan ng boto. makonsyensya naman kayo. IMPEACH ARROYO NOW!!!

i suggest you bang your head to a wall 10 times. That should kick
a couple of neurons that could bring you back to reality.
Your problem really is there is too much ‘details’ going on in your

only outlet is that computer monitor and keyboard that is in front
of you. Your Mommy and your Daddy probably locked you real tight huh ?
Why dont go outside your room. Smell the air. Look at the people around you.

democracy doesnt mean to make a travesty of the rule of law. kamo marami kasing mga interes o baho ang mga congressmen na pinanghahawakan si gma. democracy in action is not letting party loyalties or one’s personal interests get in the way of the common good, ex the bipartisan involvement in the removal/resignation of nixon.

The “IF” theory I guess. And the so-called perception of democracy. I tell you what is happening in congress is NOT the democracy I fought for. Read all the lines, the anti-impeachment lords said themselves that its all about numbers. So are you preaching the democracy of numbers then? What about conscience? justice? and truth? So you say and you adhere to democracy as capable of tramping at the TRUTH and to you its “A” ok as long as its democratic?

The truth about democracy is that ITS NOT FOR SALE. How many congressman say he will not signed in the impeachment because its false? ONLY A FEW. Where a lot say its because of party-preference that they not bother to look at the allegations.

Whereas you say that the opposition failed to plan early – o how foolish they are, right? So what can you say when Malacanan planned the Lozano complaint to disrupt the process on a technicality? Huh?!? Its BAD for the opposition to be wrong but GOOD for Malacanan?

With due respect, kindly compare your “ perception” comments vis-avis Alecks Pabico’s “Lutong Makaw “ entry on Soliman’s acknowledgement where he wrote, among others, that “Soliman acknowledged in a press conference this morning that she was witness to the conversation between Pres. Arroyo and her political adviser, Sec. Gabriel Claudio, to order Alagad Rep. Rodante Marcoleta, an Arroyo ally, to immediately endorse Lozano’s complaint”

After comparing the two enties, it will not escape you how the words perception and witness interlock with each other.

Perception as defined by Merriam-Webster means either of the following 1. As a result of perceiving: observation 2. A mental image: concept. 3. Appreciation 4. Discernment. While being a witness in the Philippine setting, as defined by our Revised Rules of Court (Section 20, Rule 130) as “all person who can perceive, and perceiving, can make known their perception to other, may be witnesses” except disqualified by law. So far, I have yet to hear of any Dinky’s would be disqualification.

And to further test the legal correctness of your statement that “ Perception/intention -hindi mong puedeng dalhin sa korte yan” and other issues of legalities, kindly convince Malacanang and Congress to finally allow the impeachment trial to proceed.

Yes, this is not a game and definitely this is our country, and let’s do our share fair and square.

manunga, those congressmen are bayad. PERIOD. And they really plot a plan to tramp the impeachment process as they say – with numbers. The question is how did they muster that number? Well take a look at how and where Malcanan is pulling its appointees right now, and the Road User Tax etc.

You see these irregularities should be accoutable to the President.

If I recall right, I believe there are other commentors here who manage to post far more than I do in a single day. An example is this “noelet” guy who manages to post 2-5 consecutive comments in one go (mcuh of which consist of nothing more than ad hominems much like your own posts). So if there’s anyone around here who doesn’t seem to have a life, I don’t think it is cute little moi.

Then again, most Pinoys don’t have much of a life nowadays, do they? 😀

This opposition is the worst this country has ever seen. Pa-pogi at media exposure lang ginawa nila. And that’s why we’re back to square one. The fact that the impeachment did not go thru Congress does not bode well for the country. I do blame the opposition for not doing a better job of getting the impeachment through. I was looking forward to this impeachment so we can all move on. No complaint was filed for weeks and I was wondering why everyone was clamoring for resignation when impeachment was a viable, legitimate alternative to get GMA ousted – YET no one was talking about a complaint. But that’s your logic.

Democracy by numbers is an assurance that more people will decide for the greater good. It is not a precept that Democracy = numbers. Not in your dreams either.

What is happening in congress is numbers and definitely not democracy. Or probably it is – but ONLY a democracy as you envisioned personally. In truth, what is happening is the rule of muscle.

O MitaMS i believe ur not a lawyer to suggest that Dinky’s revelation is just perception. I don’t know how blind people gets. Dinky witnessed GMA and Claudio talking regarding the Lozano complaint and to endorse it.

Use common sense here – who among you would try to persecute himself in court? GMA and Caludio arranging the endorsement of the lozano complaint is tantamount to filing a charge to yourself.

The perception is that it could be a gran-plan. But the witness showed that there was an apparent manipulation in the procedures.

Regardless of our source whether Dinky really heard or overheard or perceived to believe that the so-called “unholy” plot to rig gloria’s impeachment, is a legal matter that need to be threshed out in a proper forum which is the impeachment trial. In layman’s term, Dinky is a qualified witness, if not a credible one.

If you have watched earlier the manifestation of Edmund Reyes, it will dawn about you how Malacanang resorted to “extra” legal means to achieve their ultimate goal of proctecting their principal. There is no question that the law requires at least 79 signatures for the complaint to reach the Senate but the ultimate question is what prevents it from happening? Is it the law? or Is it the invisible hand that circumvents the law?

We talk about the rule of law with impunity but some are simply blinded to subscribe faithfully to the its real meaning.

The discussion here is getting tensed, huh. Well, i can sense, mr Benign0’s diatribes stemmed from his ignorance and bereft understanding of the filipino spirit as a people. That we, no matter how may be in want of material developments have never lost our focus on what is right and what is wrong. That’s why our efforts in the case of GMA and many others before her is about fighting the good fight against what is not morally right. Voting somebody inconspicuous like Erap into the presidency is but an expression of the majority of us to give a chance to less learned to do good since many intelligent men before him have bungled on their oath once in power. That should not be taken against us. When we vote, we have only in mind the possible good and that our candidate can do to out country. Nobody can be absolute though what they might become as servant, supposedly, of the people. It is not part of democracy to preclude us from doing action against a public official who betrayed our trust. let alone allow them to lie on our face and we go on with our lives. No way.
