FINDINGS of the military fact-finding report made public Wednesday night that cleared the so-called “Hello, Garci” generals of any complicity in the alleged rigging of the 2004 elections are conspicuously silent on the other high-ranking military officers accused by a group of junior officers of having also involved in electoral fraud.

In August last year, the Young Officers Union of the new generation (YOUng) identified 10 officers of the Armed Forces of the Philippines (AFP) suspected of participating in poll results manipulation to favor Gloria Macapagal-Arroyo.

Aside from the four generals mentioned in the Garci recordings (Army chief Maj. Gen. Hermogenes Esperon, Southern Command chief Maj. Gen. Gabriel Habacon, retired Lt. Gen. Roy Kyamko, and retired Brig. Gen. Francisco Gudani), the YOUng also urged the fact-finding board headed by Vice Admiral Mateo Mayuga to investigate the following top AFP officials:

  • Brig. Gen. Nehemias Pajarito, then colonel and commander of the 104th Brigade assigned to Sulu’s first district

Allaga and Pajarito reported and took orders from Gen. Habacon, who was then the commander of the 1st Infantry Division based in Sulu, during the elections. The newspaper Malaya reported last year, quoting retired police general Ramon Montano, that Habacon had distributed funds to Commission on Elections officials, Allaga and Pajarito during the elections. Allaga and Pajarito, Montaño said, had also barred poll watchers from observing the canvassing.

Both Allaga and Pajarito have since been promoted to brigadier general.

It will be recalled that Allaga’s surprise appointment as Marine commandant sparked a protest among the ranks of the elite unit, leading to the seven-hour standoff in Fort Bonifacio last February 26.

Also on the YOUng list were the following officers:

  • Navy Capt. Feliciano Angue, then head of Naval Task Force 62 operating in Tawi-tawi and now Navy operations chief
  • Marine Lieutenant Colonel Fred Pelonia, commanding officer of the 1st Marine Battalion based in Tawi-tawi
  • Marine Lieutenant Colonel Elmer Estopin, commanding officer of the 10th Marine Battalion based in Sulu
  • Army Colonel Rey Arde
  • Army Colonel Aminkadra Undog
  • a Colonel Pereno
  • a Captain Perez

Col. Pereno is believed to be Col. Gominto Pirino of the 5th Infantry Brigade, who replaced Brig. Gen. Francisco Gudani, now retired, as head of Task Force Ranao during the elections. Gudani testified at the Senate last year that his relief for no apparent reason was a maneuver by the Commission on Elections, with the help of top military officials, to “slacken” security in Lanao del Sur, leaving the door open to massive cheating in the province in the May 10, 2004 elections.

Pirino is also the same military official that Abdullah Dalidig, Lanao del Sur provincial chapter chair of the National Citizens’ Movement for Free Elections (Namfrel), identified as the one who approached him at the height of the canvassing in 2004, telling him not to report the election anomalies in the province.

In his affidavit submitted to the Senate defense committee looking into the “Hello, Garci” scandal, Dalidig divulged that Pirino went to the Namfrel office in Marawi City and advised him against exposing dagdag-bawas (vote padding and shaving) operations since:

“…being a townmate from Balindong, Lanao del Sur, he was promised to be promoted to general and many good things for me would be forthcoming but I didn’t listen to him, thinking that I would turn traitor to Islam, to my people and the Republic.”

Junior officers, who asked not to be identified, also criticized the findings of the Mayuga report. “Puro kasinungalingan yan, sir. Binaboy nila ang Marines, sir (It’s all lies, sir. They dishonored the Marines, sir).”

They also disclosed that during the investigation, Mayuga listed their names as resource persons to attest to the election anomalies. “We waited for that to happen pero di kami pinatawag. Ang gusto lang namin ay maibalik ang dangal ng Marines (We waited for that to happen but we were never called. All we wanted was to bring back honor to the Marines).”

A senior officer said that if Executive Order No. 464 will be lifted, a lot of those who might have personal knowledge of what happened might come out and follow the lead of Gudani and Lt. Col. Alexander Balutan.

Gudani and Balutan defied Arroyo’s gag order on executive officials, including the military, from testifying before congressional inquiries without her permission. Both are now facing court martial proceedings.

– I sympathize with you, brothers.

Wala..dahil walang kakampi sayo. Get out of the system at gawin mo ang alam mong tama. An officer and a gentleman will remain an officer and a gentleman to the end kahit wala ka sa serbisyo.

Mali ka naman diyan, Scud. To effect change in a system, you cannot be an outsider. Like any institution, the military cannot lick corruption should those who can institute the corrective measures choose to resign and work for reforms outside.

That’s exactly the propaganda of the present tyrants in the seat of power. Stifling dissent by branding reformist officers as coup plotters and charging them before the military tribunal will do more harm to the organization as it only promotes the status quo where the padrino system rewards the incompetent but “loyal”, at the expense of the qualified but unconnected. I put quotes on the word loyal because the military sense of loyalty has now been degraded to loyalty to persons instead of loyalty to the flag and country.

The disease that has stricken all public servants, not just the military, is that they have forgotten whom they are supposed to serve.

But this chain does not stop at the comander-in-chief.

Ultimately, the people are the supreme commanders. When the supreme commanders’ orders, written by hand on the ballots were switched with fake ones, or by dagdag-bawas, supplanted with unauthorized ones, wasn’t this chain of comand broken?

Kawal, sino ba ang dapat parusahan?

Article II, Section III of the Constitution. – “Civilian authority is, at all times, supreme over the military. The Armed Forces of the Philippines is the protector of the PEOPLE and the STATE. Its goal is to secure the sovereignty of the State and the integrity of the national territory.”

Madaling sabihin, hindi po ba? Pero kung kayo kaya ang nasa posisyon namin..you want to help the PEOPLE you sworn to protect and at the same time you are ordered by the STATE represented by the Commander-in-Chief to do something illegal.

They are heroes if they win, court martial if they lose.

I think I know enough about the hardships of the lower level officers in the military having been associated with many of them playing tennis and golf at Aguinaldo.

Lim at Col. Querubin. You are military specialists. For once, read the minds and sentiments of the people and not your self-serving leaders.

People over the State Principle.

Jaraula na nagsasaad na “…the Armed Forces is the protector of the State and the fundamental rights of the People”.

P.S. on 1987 Constitution, i never have an extreme liking to it. it is too wordy, open-ended and full of ambiguities, save for the Section on Armed Forces tackled above. The framers should have incorporated a separate provision giving ” … rights to the people to BEAR ARMS”.

Kaya nga nasa Section 1 ang “Sovereignty resides in the PEOPLE and all government authority emanates from them.” Di ako kontra dyan. But because of of Presidential System of Government na ang Commander-in-Chief ay ang Pangulo who represents the State, di nyo ba naiisip na ang nakasulat sa constitution is more of a THEORY than a REALITY?

That’s an Order” at “Obey First before you Complain”.

IS AT ALL TIMES, SUPREME OVER THE MILITARY” . Baguhin natin ang konstitusyon at alisin ang Presidente bilang Commander-in-Chief

Actually, our soldiers are aware of their rule as far as protecting the constitution, the people and the state are in concern. Even during the 2004 election, a lot of our principled Generals, junior officers and soldiers in the field are already aware of the cheating going on in varying degrees and in various parts of the country. However, they failed to take immediate actions because of their inherent training of following the chain of command and their basic tenets in following orders and questioning later ( in fact one wonders if they have the gall to question their superior officers).

The stand off in fort bonifacio is one classic example of believing in such tenets in military training; and sadly to say, it was this training that are being capitalized by GMA and her minions of corrupt generals in the Armed Forces of the Philippines and in the Police Organizations.

The Mayuga report, sanitized as it was is just a piece of scrap to continue to fool the people.

I think, the dignified officers and soldiers of the Armed Forces are just waiting for the catalyst from the people to trigger the uprising to save the constitution, the people and the State as what they have vowed and sweared as Filipino soldiers.

We were struck of taking active participation because of the CPR and 1017 as declared and promulgated by GMA to save her ass from being thrown out in Malacañang Palace. We can however have a non violent protest against the usurper in the office by starting to perpetrate civil disobidient to paralysed the government. We should stop paying our taxes, boycott the plebisite if ever the PI is declared constitutional by the SC, boycott businesses of those who are supporting the PI…etc… we need not go out the street to face the riot police who are hampered by their blind obidience in the chain of command. All we need is a no-nonsence campaigned to arrive at these goals.

Here is an inspirational site in the life of Mahatma Gandhi he whom by advocating civil disobedient had successfully liberated his country from the hands of a tyrrant government. http://en.wikipedia.org/wiki/Mohandas_Gandhi

REPUBLIC ACT NO. 7055

AN ACT STRENGTHENING CIVILIAN SUPREMACY OVER THE MILITARY BY RETURNING TO THE CIVIL COURTS THE JURISDICTION OVER CERTAIN OFFENSES INVOLVING MEMBERS OF THE ARMED FORCES OF THE PHILIPPINES, OTHER PERSONS SUBJECT TO MILITARY LAW, AND THE MEMBERS OF THE PHILIPPINE NATIONAL OFFICE, REPEALING FOR THE PURPOSE CERTAIN PRESIDENTIAL DECREES

“Section 1. Members of the Armed forces of the Philippines and other persons subject to military law, including members of the Citizens Armed Forces Geographical Units, who commit crimes or offenses penalized under the Revised Penal Code, other special penal laws, or local government ordinances, regardless, of whether or not civilians are co-accused, victims, or offended parties which may be natural or juridical persons, shall be tried by the proper CIVIL court, EXCEPT when the offense, as determined before arraignment
by the civil court, is SERVICE-CONNECTED, in which case the offense shall be tried by COURT-MARTIAL: Provided, That the PRESIDENT the Philippines may, in the interest of justice, order or direct at any time before arraignment that any such crimes or offenses be tried by the proper civil courts. ”

Article VII, Section 17. “The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed”

Article VII,Section 18. “The President shall be the Commander-in-Chief of all armed forces of the Philippines and whenever it becomes necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion or rebellion”

So ano ang dapat gawin?

May nangyari ba? Wala. Matagal na din nating naririnig na ‘let’s all go to Edsa!” May sumunod ba? Wala.

Bagamat sangayon ako sa pagamienda ng ilang mga provisions sa Constitution specifically those that are needed for economic reforms, hindi ako naniniwala na ang shifting of govt to parliamentary is the panacea for all that ails our political and economic systems.

What is so urgent that the parliamentary must be in place in July. We have waited this long why can’t it wait for next year? The people must be fully informed. The only reasonable excuse I can see is with the parliamentary in place in three months the impeachment provison will no longer exist. If the idea is to save Gloria the intent and purpose is indeed highly immoral and despicable.

This is your chance to show your contempt.

Hi everyone, posting here besides dozen of kids at internet cafe at brookside hills in the neigborhood of atty bello residence and it’s scorching hot. My only other comment this time its nice to be home and taste the real San Miguel. Anyways, it may be true that most heads of the government in most form are also the commonder-in- chief, but military decisions are usually undertaken by the cabinet and the prime minister in the case of parlimanetary system, upon the reccomendations of military top brass. That is following the wisdom that military men are the people qualified to put forward options for their commander-in-chief to choose from. And I am just wondering why a military officer investigating the alleged wrongdoings of another military offficers? The results were obvious before they are released. Meanwhile time to cool off and hit some beer garden. hi scud its hot hot how’s the true north?

Hi naykika, finally spring is here. No more winter blues! hehe. Wow, nakakainggit naman San Miguel mo..its still the best beer in the world for me. Walang binatbat ang Heineken at Budweiser.

Anyway, back to topic. It’s really important to inform the Filipino people kung ano ang magiging lagay ng Piipinas kung sakaling maging Parliamenary system tayo at sa magiging epekto nito sa AFP. The Head of Government may not be The Head of State (imho, pang ceremonial lang). In our present system, where the promotions of Generals are under the whims and caprices of Commision on Appointments, and the ordinary soldiers are being used as human shields of politicians..pano natin masasabing dapat apolitical ang AFP?

The President is the Commander-in-Chief of the Arm Forces of the Philippines, all right! But the support of the military to Arroyo had gone too far: lying and deciving the people. Is there something left for the citizens to continue in their involvements to the future of the country? Not that much, unfortunately! Arroyo and her bandits even robbed the Filipinos of their basic rights, their votes! No wonder why the military is losing their reputation. They don’t deserve it anymore, least entitled even to a respect!

It is not fair to give a sweeping repudiation of the entire military establishment for the sins committed by a few who allowed themselves to be used by and be subservient to ambitious political leaders. It is precisely that there are dissensions within the military between those largely in the majority who want to follow the rule of law and those few high officers who do not, and the only thing that holds the establishment together is that thinning chain of command that many of them do not want to be broken. Respect not the rascals in the military, but the establishment deserves absolute support.

You can talk and talk about this and many other issues that plague the country since Marcos took over and have the military taste power and money till thy kingdom come and all you’d achieve is a humongous collection of words. Myriad of editors, columnists, newswiters, opinion makers, newscasters, and commentators from all the available media, including school organs and NGO newprints, report in painstaking details on the ails and travails of the country every single day, in most kind of styles, good and/or bad, for more than a quarter of century now, and what has the whole exercise produced- a country that continues to spin down to the abyss. Everyone knows the situation and real score. Only those with vested interests sugar-coat reality. The late Teddy Benigno till his death never gave up the fight to enlighten the citizenry of what it had been, what it was then, and what it could and would be, day in and day out, in his daily column. And he ended up with practically nothing. Now comes the latest medium of the internet that is supposed to have more readership among the upper crust of the society, and what do you get- more of the usual-DADA-AN and DAKDAKAN from here to eternity. The mountain labors and all it produces is a mouse.

Even the village idiots know what the real problem of the country is. No need to beat a dead horse. The French did what was necessary. The Russians did it too. We all know that the problem is not the DRIVER but rather the VEHICLE. No matter how good a driver you put in a dilapidated car, the car won’t go far. On the other hand, if the vehicle is in tip-top condition, the driver won’t matter. Look at BUSH…..U.S.A. still hums despite of him. But if we are going to change our car, might as well get a good driver to make sure that the car is driven well and properly.

We have a saying in the vernacular that goes: ” Kung hindi makuha sa santong dasalan, daanin sa santong paspasan”. Someone else cited Lim Seng. Good example. People usually remember very well and intently when they see an event associated with blood. I say let the heads of the THIEVES of the country roll. (It will take probably months to complete the task).

Aprub ba, bro?

Nothing is really hidden from God, and despite the hallucination and illustion of Usuper Gloria Arroyo that she is God ‘s annointed as what she said. Gloria is more clever than Lucifer. We all know the truth of how she cheated and squandered public funds in the last election. One these funds in fact are the monies paid for by the OFWs all over the world.
Now our country, is conisderd as number
exporter of humans on earth and/or nations of nanies. Gloria corrupted or prostituted everythings; the CBCP, military, tongressmen, etc. AS ,long as Gloria and her cohorts still in Malacanang they will continue to deceive the people and lead our country to distruction. We could not expect the report of Mayuga, that’s already cooked.

From the passage of Holy Bible, hebrews 4:13 ” Nothingd is all creation is hidden from GOD’s sight everything is uncovered and laid bare before theyes of HIM to whom we must give account.”

February 6th, 2007 at 7:30 pm

[…] Another controversial fact-finding report — the Mayuga report, which probed into charges of fraud during the May 2004 elections, has yet to be released in its entirety. The Mayuga report cleared the four generals mentioned in the ‘Hello Garci’ tapes and remained silent on other top military officials that had also been linked to allegations of cheating. It is pointless to create fact-finding bodies if their recommendations are never released to the public. In order for the merits of the Melo report to be adequately analyzed and ajudged, its contents must be fully disclosed. extra judicial killings, gloria macapagal arroyo, melo, military, philippinesPosted in Governance, Human Rights |  […]

Makulit na pinoy

August 19th, 2011 at 10:43 am

God bless us all!
