OPPOSITION representatives filed at 9.30 this morning the amended impeachment complaint against President Gloria Macapagal-Arroyo. The number of signatories fell short of the 79 that would have shortcut the process and allowed the complainants to directly transmit the articles of impeachment to the Senate. In a television interview this morning, San Juan Rep. Ronaldo Zamora said the anti-Arroyo bloc has "more than 50" willing to endorse the complaint but so far only about 40 have actually signed. This means that the complaint will first be heard by the committee on justice, which will determine if it is sufficient "in form and substance." The justice committee is stacked with Arroyo loyalists.

The charges in the impeachment complaint are a hodgepodge of allegations ranging from election fraud to onerous government contracts, to concealment of assets and, in an apparent concession to the radical left party-list representatives who endorsed the complaint, also the killings of activists. The main charges include:

  • Undermining the independence of the Commission on Elections
  • Knowingly conspiring with the Comelec to commit election fraud
  • Obstructing justice by falsifying evidence and covering up information related to the "Hello Garci" recording  
  • Concealing ownership of properties in the Philippines and abroad
  • Approving contracts grossly disadvantageous to the government, including the North Rail and Piatco NAIA terminal 3 projects
  • Accepting jueteng payola and using this to bankroll the presidential campaign and bribe officials including Comelec Commissioner Virgilio Garcillano
  • Allowing the use of government funds, including the PhilHealth and Road Users’ tax, to promote her presidential candidacy 
  • Providing impunity to the killers of political dissenters

According to existing rules, the justice committee has 60 session days to deliberate on the complaint. The count begins on the day it receives the complaint from the Speaker, who has already included it in the Order of Business. If the justice committee finds the complaint sufficient, it goes to the plenary, where one-third of the members can vote to impeach the president. If, however, the justice committee throws out the complaint, the president can still be impeached if one-third of the House members vote to override the justice committee’s report.

For now, it looks like this will be a long drawn-out proceeding, with the limelight now shifting to the justice committee. Maguindanao Rep. Simeon Datumanong, the committee chair, said this morning that even if the opposition gets the 79 votes in the next few weeks, they can no longer shortcut the process. Datumanong promised that "the committee members will have an objective mind and will be very fair."

vlage. i disagree. it is a hodgepodge indeed and with the concessions and all. but the parts of it with the core accusations were good enough. certainly an improvement on the original lozano complaint that was also included. but bungle is too strong. but i will agree parts of it look rushed.

And while they’re at it they should have included in the impeachment rap sheet the persecution and crucifixion of Jesus Christ, the Holocaust, the ethnic cleansing in Yugoslavia, the Gulags of the old Soviet Union, the Pol Pot regime in Kampuchea, 9/11 and similar crimes. No difference.

Let’s face it, this is in reality the opposition’s last frantic chance at bringing down this President. They are desperate enough to do so before her economic reform programs start to bear fruit in the countryside and in the lower income classes as well as alleviate the dislocations in the middle class. They will not allow her to further shape the infrastructure that makes for a more hospitable investment environment. It will always be necessary for them to whip up a political storm so that the country’s unfavorable image persists. It is all because of a naked desire to grab power in the most cacophonic fashion by either reverting to a regressive form of governance or introducing a chaotic and violent form of political transformation. This poor blighted country.

I just hope that we are all with consicience enough not to justify a wrongdoing just because we are not the only ones doing it. Should this be our line of thinking then it would be right for anybody orfor all of us to steal, cheat, kill, just because there are people who do also do it.

With such a line of thinking, we ssurely are gone to the dogs.

We Filipinos, my parents have taught us, may be poor, but we are proud to say that we have a conscience. Our integrity should be more important than any material possession. The reason we are in this mess is because of the undue importance most people give to worldly possessions. May be many have become agnostics who do not wish to acknowledge anymore the fact that the most practical thing to believe in is that all of us will die, and that life here on earth is a mere passing.
May God have mercy on our souls!

even my nonlegal mind cannot help but ask: Are they really serious about impeaching Gloria? I thought for a while that she will be impeached because of the Garci Tapes. Why add all these burloloy charges? Is it because the Garci Tapes by itself is inherently WEAK? Now, I am more inclined to say that the opposition is now retreating from the original design to OVERTHROW Gloria by PEOPLE POWER thru the one-two punch of Juetengate and the Garci Tapes, and having failed to do that, into just inflicting on her serious political damage. If my suspicion is correct and the Garci tapes accusation is destroyed, I can very well predict that their next move will be to boycott the impeachment proceedings and cry obstruction of justice by the admin congressmen. By doing so, they believe they will be placed on a higher moral ground and capture the next election.

-what economic reforms on the countryside are we talking about? business in general decreased by 30 percent. on top of that you have rising costs in electricity, water and food prices. on top of that you have the evat. if she’s really serious bout countryside development then she should.
1. finish the irrigation project here in luzon di ung natiwang wang lang ng ganyan.
2. focus on argriculture the key to a sustainable development be it in the countryside or in the country as a whole is for ur to have a cheap and abundant food supply.
3. encourage all those squatters in manila to return to their respective provinces. analyze each provinces’ potential and help them start core industries.
4. put a stop to smuggling/dumping of agricultural products drugs etc.
bad enuf they’re putting our local businesses outta biz. they encourage corruption on all levels of government.
5. all government contracts should be posted on the internet for eveyone to see. for transparency

wow…parang nilunod ng ibang charges ang pinaka sentro sa lahat ng mga kaguluhan ito…seryoso ba sila na mapaabot nila eto sa senado or talaga lng gusto nilang dagdagan pa ang kalituhan ng maraming pinoy tungkol sa karapatan, moralidad at kakayahan ng pangulong mamuno…mukhang hindi sa senado ang pakay kundi sa kalsada…pag nagkataon lalong magiging kawawa na naman ang mga juan at pedro…

many are threatening that they would go to the streets in case the complaint fails to go to the senate. but what if they fail to get the numbers? would they cry dagdag-bawas?

can the justice committee recommend to trim down the charges to the relevant ones?

Nothing will happen positively in the planned impeachment complaint to be filed in the House.The context of this institution is too beholden to the President.Remember the national canvassing last year produced the tyranny of numbers to suppress legal challenges to the CoCs by the opposition.History will repeat itself, the majority will suppress the complaint and moved by passion rather than reason because this institution is not free from patronage politics.The immature political arena we have will only break loose the issues in the streets if the truth is suppressed repeatedly by an institution which is thronged by patronage and favors.Though there are some progressive groups inside, however, their numbers is not sufficient.The instability of our political institutions stems from the suffrage system we have that is based on patronage that is why personalities are elected rather than issue oriented individuals.A regime change is necessary to overhaul the rotten system and get rid of patronage so that good governance and national development can complement each other to bring about genuine reforms in a country known for people power movements which have no backbone once the successors and beneficiaries of the new status quo begin to take hold political power.

^ wow…in my opininon, ideas like regime change without popular mass support is very dangerous despite desirable if this is pushed to happen within a short period of time. a gradual change free from violence would be more palatable to the common tao.

the impeachment complaint likewise would be a failure based on political partisanship. despite the charges that were filed, without a real damning evidence that politicians would be real afraid (people’s backlash) to vote against, chances are they would vote based on party lines and not based on evidence.

this is what the opposition and left-leaning groups are trying to feed the people with this early. thinking that their ends would not be met by the impeachment trial, they want to short-cut the process that, though thru to their miscalculations perhaps, didn’t materialize as the rallies failed to snowballed into larger ones.

i don’t know where this political chapter bring us but currently we are in a lose-lose scenario. either way, the longer this will be, mas lalong kawawa si juan, kasama na rin si pedro.

Wala magagawa ang oposisyon but to amend the complaint filed by Atty Lozano and rushed the filing thereof otherwise the original one or the other one filed by a “who’s that” individual, which is a replica of lozano’s complaint, will be endorsed by JDV to the justice committee. Once endorsed no impeachment complaint will be entertained due to the provision that only one complaint should be lodge and endorsed in one year.

to those not so familiar with PIATCO. I have read that the charge
strangely enough is backed up by a wiretapped attempt at extortion.
If true, just exposes just how rotten GMA administration is.

And so we have a strange case hear of double wiretapping supposedly
inadmissible as evidence.

If they would have allowed garci to be played. I wonder if they will now invite the Germans to play back the PIATCO TAPES as well.

Now that would be WEIRD.

as for that POLLUTED evidence defense.

Sadly, it worked for OJ. despite overwhelming evidence including OJ’s DNA at the crime scene at that.

Wycoco’s testimonies about TAMPERED. The unbelievable P25 million
LEMON wiretapping equipment.

( Sino ang bobo bibili ng expensive equipment without a Test drive. Not compatible daw when there is only one GSM system worldwide.)

and an incorrect allusion
to Ali and Rocky Marciano never having fought but all done by computer.

(They fought in a ring and was filmed. But it was scripted.
Rocky Marciano died in a plane crash not long after that session.
The computer was the FAKE one, it made a scripted simulation.
A bad testimony by Wycoco. buking. trying hard)

Doble’s unbelievable denial of not knowing wiretapping. obviously
being coached with his 3 wives being hostaged.

all of this point to a POLLUTED source defense.

It worked with OJ but hope to goodness it won’t work here. (UNless magpapauto tayo)

COMMON SENSE lang po ang kailangan. there is no JURISPRUDENCE because si Gloria palang ang bbobong presidente na MABUKING
calling GARCI to commit election fraud.

So the answer to the question is GLORIa is making JUDICIAL HISTORY.

I really think that PIATCO is a sleeper issue. most people will not notice it. but if and when it is aired out. it might bolster the impeachment case. It would serve to establish a pattern. but it would be interesting
how the prosecutors play this out.

Some of the burloloys. And I agree they are borloloys, are for political expediency, in order to hold together the alliance.

But the core of it is still : ‘HELLO GARCI’.

You requested that there must be truth commission….Now here it is.We are hunger for truth so we are pleading to give all your influence to help the opposition get the magic number to roll the impeachment proceedings.Instead of creating a truth commission please help us see the truth by asking people who wanted to do sacrifices to shed the truth.Let testimony and evidences talk for us. If the impeachment complaint goes to trash can because it did not get the magic number nor allies of MRs. Sana lang walang bumalimbing…

I am in total support of the impeachment trial of President Gloria. It shows that human rights are protected in the Philippines, that even the highest in the land can be called upon to account for his actions, and that every citizen accused of a crime has the right to the due process of law.

In respect to Escudero, I would suggest him to go back to school for his math subject. Akalain n’yo one-third daw ng 236 is 78. How come? 78 x 3 = 234, he meant it that the two remaining members ay itatapon? While those insisting that one-third of 236 = 79, another blog at nakakatuwa, if we multiply 79 x 3 = 237, sobra rin ng isa, ibig sabihin huhuli tayo ng isa sa kangkungan?

Sa ngayon let’s wait & see before our say. At sana habang penaprocess ang impeachment trial para kay Gloria, harinawa di pa tag balimbing, tiyak mayroon d’yan babalimbing. Please read my tula, puwede gamitin to blog someone.

hehehe dude hindi din importante kung 78 o 79 yan… pag nasa 75 na yan malamang yang mga pulitikong nabangit pipirma yan pipilitingmapasama sila sa nagreklamo…. lam mo naman media exposure… gusto nilang masama sa “history” hehehe

siguro tingnan nating mabuti ang impeachement noon kay erap minadali nila yung 79 daming complaint namahina yung kaso… kya nung nakahanap ng butas yung mga private prosecutor na hindi mabuksan yung envelope dinaan nila sa kalye…nung matapos yung hearing yung envelope na pinagtalunan walanglaman hahaha… nung dinidinig na kaso iniiba na nila yung reklamo… kya hanggang ngayon hirap silang mapatunayang maykasalnan si erap sa bayan… hirap silang pagkasyahin yung pera na binabangit ni Singson… sana yung mala Clarisa Ocampo ng Oposisyon ngayon hindi selective memory….

well better na rin sigro kung salaing mabuti ang kaso… yun nga lng maraming kaalyado ang pangulo sa congresso baka madaan sa technicality hehehe….

…pero kung daanin man ni gloria sa technicality ang laban hindi nya na maprove ang sarili nya beyond reasonable doubt so sana kung may reklamo man ang oposisyon hayaan nyang mailatag at sagutin nya sa sendo…. total kung mahina ang kaso wlang dapat ikatakot si GMA… “hello garci” peace!

Mukhang hirap ngang kunin yong 79 dahil iilan lang naman ang may prinsipyo sa mga Tongresman na yan! Pera lang at power ang katapat, palagay ko kung may pera ang oposisyon ay maging bidding pa yan ang labanan at siyempre patatalo ba si GMA! Hindi! di ba? maraming pera sa PAGCOR at OFW at ang kaban ng bayan, isang magic lang yan! Sana nga makonsensiya naman sila at pakingan ang sigaw ng sambayanang Pinoy at hindi yong sigaw ni GMA, FVR, JDV, Gonzalez, PIDAL Brothers, Mikey , Ermita, Defensor, Bunye at iba pang mga sipsip at linta ng lipunan!

Kapag ganyan ang mangyari at harangin ng pro-administration ang impeachment, walang ibang pagpipilian ang taong bayan kundi parliament in the streets. Dahil wala ng kakampi ang taong bayan sa mga dapat na magtangol sa kanila, dapat ay magkapit bisig na isulong ang labanan sa kalye ng katarungan!!!!makamit lang ang tunay na ipinaglalaban! Sigaw ng bayan “GMA Resign”!!!ngayon na!!!

Ang hirap sa ibang Pilipino, sasabihin ayaw kay Gloria, pero ngayong may impeachment na, ayaw din sa impeachment. Ang labo. Dapat magtake ang bawat isa ng stand. Sa pula o sa puti, hindi puwedeng wala tayong pakialam. Hindi puwedeng sawa na tayo sa panonood sa mga pulitiko. Kung mananatili tayong walang pakialam, kawawa naman ang Pilipinas. Masahol pa tayo sa mga maka-administrasyon pag nagkataon, atleast sila, may paninidigan, kahit alam nilang ayaw na sa kanila ng maraming tao, hindi ba Sec. Mike Defensor? :)

Sa magic 79 na pirma. Palagay ko, aabot. Hindi naman mag-aaksaya ng panahon ng oposisyon kung alam nilang walang patutunguhan ang impeachment nila. Mas pabor na ko sa impeachment kesa naman sa People Power. Mas dapat na manaig ang batas. Noong Edsa Dos kasi, masyado tayong naging emosyonal, marami ang nadala lang ng damdamin. Basta gusto lang mapatalsik si Erap, hindi na iniisip kung tama ba ang proseso. Kung tutuusin, may mali ang taumbayan.

Hindi magre-resign si Gloria. Wala sa karakter niya. Isa pa, siguro iniisip niya, na “Tama na ang nag-sorry ako, bakit ako magre-resign, ano kayo, hilo?”

Sa huli, may dahilan naman ang lahat nang nangyayaring ito eh. Parang lahat ‘ukol’. Kahit hindi man natin maintindihan sa ngayon, darating ang araw, malalaman din natin kung bakit nangyari ang dapat mangyari. :)

kung mananatiling mag kakaway yung mga personalidad na nabanngit
mo,wala nang mangyayari sa Pilipinas.Matututo kayong magpatawad
Marahil noong panaho ni Marcos di tayo masyadong malaya di naman
tayo masyadong gutom.dahil hawak ng gobyerno ang mga basic needs
ng mamayan.Merong OPSF na pang balanse sa pag taas ng presyo ng
langis at ang PETRON ay pag aari ng Pilipinas,Ang Kuryente di masyadong mahal dahil hawak ng gobyerno.Anf Tubig na pagkamahal
mahal ngayon gobyerno rin ang may-ari.hindi masyadong talamak ang
pag aangkat ng Bigas at Asukal kaya mayroon kabuhayan ang mga magsasaka natin.Ewan ko lang pero parang mas nais ko na ang kapanahunan na iyon kaysa sa mga nakikta ko ngayon.

Hay naku entrep , bata ka pa nga ano? Saan ba galing ang pera sa OPSF na pinagsasabi mo? Why was it abolished in the first place? Ang koryente noon hindi masayadong mahal? OO mura noon kasi ang brown-out ay 12 hours a day ( walang koryente mula 9 am hanggang 3am) generators ang gamit noon pati sa SM City at Farmers Cubao, tigil muna sine, wait ka ng two hours hanggang tumakbo na generators – kaya syempre mura, hehehe. Tubig ay mura noon – oo mura dahil walang tulo ang gripo! Hindi talamak ang pag-angkat ng bigas at asukal – bakit? alam mo ba kong gaano tayo karami noon? 35 to 40 million lang po tayo noon – ngayon we are 85 million! Ang lupang sinasaka ay ganoon pa rin kalawak! Kong gusto mo noon, cge punta ka sa noon.hehehe.

Kaya tayo nag-iimport kasi mas kumikita ang mga in-charge sa importation. kung bibili sa mga lokal na magsasaka walang kita. gets nyo? isa pa yung mais galing cebu mas mahal daw kapag dinala sa maynila. pero yung galing ibang bansa mas mura. kung walang produksiyon dahil walang puhunan ang magsasaka. kaya walang puhunan kasi walang tunay na tulong mula sa gobyerno. pumunta kayo sa norte at tignan nyo kung ano ang ginagawa ng gobyerno para sa irigasyon. kung hindi magsasariling sikap ang magsasaka, wala talagang aanihin. kung may ani naman kontroloda ng mga mamimiling intsik ang presyo. pag binili ng gobyerno (kung bibilhin) babaratin din. saan lalagay ang mga magsasaka?

Isa pang malungkot na sitwasyon ay edukasyon na dapat sana’y magpapalaya sa ating mga kababayan mula sa kamangmangan na tunay na dahilan kung bakit hanggang ngayon ay alipin pa rin tayo sa sariling bayan. wala ngang tuition pero laking gastos sa mga projects at kung anu-ano. pag di raw sumunod ang estudyante bagsak. kaya yung walang pera hihinto na lang sa pag-aaral.

I think we should start collating contact data of all known GMA allies in congress and start convincing/pressuring them to sign for the impeachment so that it could be expressly transported to senate to save time and finish the deadlock we are in, once and for all. We should act now and act decisively for our country. What do you think guys? Let us put our collective effort in this endeavor as its the time to put our words into play.

martial law baby po ako.kaya alam ko ang sinasabi ko yung sinasabi mong mga brownout panahon ni Tita Cory yon.Yun pong OPSF o Oil price Stabilization fund ay galing sa mga taong nag kukunsumo ng gasolina ang gobyerno ay nakakakuha ng 10 sentimos kada karga mo ng diesel o gasolina at ang sentimong ito ay napupunta sa OPSF.
kumbaga pang habol mo sa taas ng Presyo ng langis at yung Oil Deregulaton law ay batas ni FVR.Na sya rin mismo ang nagbenta ng PETRON gets mo ba.Ikaw ba ilan taong ka na kung ka edad ka ng lolo ko ay mas matanda ka nga sa akin..

is this being how intellegent we are that we are able to cheat in the election? my conclusion is that we must not only posses intellegence to qualify as president, but most importantly, we must have the integrity.We must also gain our trust from the people we serve.

There is no “Proper Forum” nowadays. Certainly not in the courts. The only agenda in our justice system right now is to prop up the president. They will twist everything to get whatever advantage they could get. It’s Sec. Raul Gonzales Vs. The People of the Philippines. Or something like that.
After EDSA 2 our constitution has become one big grey area. This is the best that our best legal minds could do for our people – fuck things up.
But before all these, there was right and wrong. There was justice. Or a semblance of it.
It’s time for us to go back to basics.

piatco NAIA terminal 3 fiasco, ano ba eto? Can the pcij check on it so the people would really understand its implication to international investors and its connection with the impeachment issue on GMA.

Is this a same issue that Captain Pampilo Villaruel cited when he tookover the ATO tower. An issue that should have been talk about a long time ago.

Former ATO chief, Captain Villaruel, a Pilipino aircraft inventor, a friend of President Ramos, was killed by the military while negotiation for his surrender was in the process.

I agree with GARCIGWEN’s comments about PIATCO/NAIA 3.

We have a small group of people that has so much to answer for. That’s why this is the worst time to have a charter change. Let us not change the rules just as yet. Let’s leave the footprints and traces intact if any.
