WITH the lion inside the cage already poisoned, even the mouse that is sent to face the gladiators will be strangled.

So has Makati Rep. Teodoro Locsin Jr. foreshadowed on two occasions the inevitable conclusion to the impeachment proceeding at the House committee on justice today which he likened to a Roman circus.

This evening, with practically no one to challenge their every move, administration congressmen delivered the goods for their political benefactor, Pres. Gloria Macapagal-Arroyo, voting 46-1 (with 2 abstentions), to throw away the weaker Lozano complaint — which they earlier declared sufficient in form — for lacking in substance. Before that, the committee, in a vote of 52-2, effectively barred the amended complaint, along with the one filed by lawyer Jose Rizaldo Lopez, in favor of the original Lozano complaint.   

The result is not at all unexpected. As early as the first day of hearings on the impeachment case against Pres. Arroyo, pro-impeachment congressmen and ‘civil-society’ groups have expressed doubt as to the outcome of the process when Rep. Edcel Lagman introduced his set of seven "prejudicial questions" and eventually became part of the hearing’s agenda.

Lawyers of the impeachment legal team say that it was sheer bad faith that the justice committee chaired by Rep. Simeon Datumanong, an Arroyo ally who was previously appointed by the president as public works and later justice secretary, insisted on first tackling "legally and constitutionally impermissible ‘prejudicial questions’ in order to dismiss the amended complaint."

With the majority’s formidable superiority in numbers in the 95-member committee (the minority has only 22 or so members), it was therefore easy for the "prejudicial questions" to have been given priority over the determination of the form and substance of the complaints which the Constitution and the impeachment rules mandate.

The Constitution and the rules of procedure clearly provide only a two-stage process of deliberation over the sufficiency of any impeachment complaint: the first being sufficiency as to form, and the second being sufficiency as to substance.

"These are the only threshold matters to be deliberated upon by the Committee on Justice on the sufficiency of an impeachment complaint, nothing more, and nothing less," the lawyers say.

As it turned out, Lagman’s "prejudicial questions" since reduced to only two, were made the vehicles for the eventual elimination of the amended complaint.

First, with a vote of 54-24, the committee declared the amended complaint as separate and distinct from the Lozano complaint. A subsequent  47-4 vote virtually knocked out the amended and Lopez complaints to the benefit of the Lozano complaint, which, with its apparent defects and infirmities, was just the easy strawman that Arroyo’s allies in the committee can demolish (and demolished it had been) as a guarantee that the president will not be impeached and convicted.

It would also be worth noting, the lawyers add, the counsel of eminent legal scholar Prof. Antonio Bautista, who has recently been tapped to help in Pres. Arroyo’s legal defense, on the issue. Proposing to do away with the legal animal called "prejudicial questions," he said:

…The  doctrine of prejudicial question serves no useful purpose. The specter of confusing rulings on the same issues is just that – a specter…[T]he doctrine has conduced to much harm and unnecessary litigation over elusive and conceptually befuddling issues of sameness, determinativeness and precedence…It would be best to do away altogether with the doctrine of prejudicial question. Let the criminal  court decide the issue regardless of whether the same or similar result is contemporaneously litigated in a civil action. There is no good reason for the criminal court, which may even be the same court, to defer to the civil court.

With the justice committee granting the "prejudicial questions" an undeserved preeminent status, what really happened at the impeachment hearings has been more the triumph of the rule of the majority than of the rule of law.

This is the deciding factor who is right between the “pro” and anti-impeachment congressmen. I just hope they are on Berna’s side considering the congress quote him all the time.

No need to change the form of government, reform in the Congress is what we need. Gloria for now is as good as the Government coffers, if she you can’t sustain in buying the Trapos… she’s done. Watching the Impeachment proceeding on TV is like watching a replay of what happened during the Marcos years. It brought me back 30 years ago, because what has happened has already happened 30 years ago. And I thought that I will never see the likes of the Marcos years again in my lifetime. I guess I was wrong. I wonder where are the young people of today? I saw some being interviewed on TV playing video games and seems not to care of what is happening to our country. I hope and pray that the youth will realize that they will be the most adversely affected by all this, not old people like me whose days are numbered. My prayers are with our young heroes who are trying very very hard to fight for TRUTH, JUSTICE AND COUNTRY .

Ang sistema ay hindi problema. Marami ang nagsasabi na nilamon sila ng sistema kaya nagkaganyan. Ang totoo ang sistema ay katulad ng isang baril na maaaring pumatay ng isang criminal o magligtas ng buhay ng isang nasa panganib. Ang responsibilidad ay nasa taong gumagamit ng baril – nasa kongresistang gumagamit ng sistema.

Hindi sila nilamon ng sistema – nalulong sila sa pera at sa marangyang buhay na ibibigay nito.

Impeachment did not happen just yesterday ma friend. And since this is a political persecution – it is more the duty of the accused to prove her innocence. Evidences and witnesses shows that she’s guilty and her ONLY reply is a verbal “not true…”

On top of that she trample on the impeachment process.

No. There is no rule of law to begin. The whole process was infact, using Edmund Reyes term, “bastardized” by pro-gma congressmen-lawyers.

The rule of law, in real sense, sees fairness and justice prevail. Other wise, its the rule of the LOW.

Napakasarap makita, kahit minsan, ang pagsikat ng araw sa bansang ito na walang huwad na liderato na inilukluk ng sistema na siya ring bumaboy sa ating mga Pilipino.

Ang kaibahan ng “paghaharing kadiliman” noong rehimeng marcos ay sa kadahilanang hindi lahat ng mga Pilipino ay may gamit “kumunikasyon”, tulad ng T.V., cellphone, computer atbp.
Niloloko noon ang mga tao, sa kadahilanang hindi lahat ay alam ang mga tunay na nangyayari sa loob at labas ng pamahalaan.
Kung kaya’t nauso ang katagang “mulat”, sa kadahilanang hindi lahat ay alam ang mga kaganapan.
Ngunit sa panahon ngayon….letse!!!..alam nilang alam natin na ginagago nila tayo. Ito ay harap harapang pagsasamantala o “rape” sa ating mga “pang-unawa.”
Hindi ko matanggap na para nilang hinahamon ang mga “kakayanan” nating mga salat sa yaman at kapangyarihan.

Nueva Vizcaya Rep. Rodolfo Agbayani said he withdrew his endorsement after the House of Representatives Committee on Justice ruled that the original impeachment complaint filed by lawyer Oliver Lozano barred all other impeachment complaints.

“That as the Amended Complaint which I endorsed, has not been given due course, but in fact, ruled upon by the Committee on Justice to have been barred by the original Lozano complaint…I am now executing this sworn manifestation to clarify and state my stand that I should now be considered as having not endorsed any impeachment complaint including the Amended Complaint,” he said in his affidavit.

huh! davide pahirap sa tao. 15-0 unanimous decision ng sc sa e-vat. wala ng magagawa petitioners dito kasi unanimous eh. maghihirap na naman lalo ang taong bayan. parusa talaga. sa tinde ng presyo ng lahat ng basic needs esp power & energy wala na lupaypay na si juan dela cruz. tiyak nagtatalon sa tuwa ang bogus na presidente sa desisyon ng sc court. wala talagang habag itong gobyerno ni aroyo. berdugo talaga. may magagawa pa ba ang pobreng mamamayan?

“foresight” is the name of the game…and malacañang has plenty of it. as apparent in their preemptive strikes, to name some:

– administration allies’ filing of protests/charges on various issues against the presidentiables FPJ (nationality), Roco (graft), Lacson (drugs), etc. (before the May 2004 elections)
– the “fielding-in” of EDDIE gil as a presidentiable (to preempt bro. EDDIE’s candidacy)
– operator’s manufacture of election summaries (ERs, SOVs or COCs) to favor GMA (before the congressional canvassing)
– congress “dawn” proclamation of GMA as winner in the 2004 election (before entertaining FPJ camp’s objections/protests)
– switching of election summaries (ERs, SOVs or COCs) safely kept in congress to really show GMA’s more-than-a-million lead in the 2004 election [before the PET (the Supreme Court) orders the reopening of the ballot boxes]

– bunye’s release of the “hello, garci” tapes (before sammy ong did)
– “softly-touching” or perhaps really blackmailing and/or bribing witnesses/“whistle-blowers” (before they cause extensive weakness to GMA’s stronghold to power)
– GMA’s request for cabinet members’ resignation (before the “hyatt 10” did their act)
– JDV and FVR’s rally behind GMA’s skirt (before cory & co. could topple the government by forcing GMA to resign)
– allowing Gil “yes, ma’am” Garci to escape (before he is brought to congress – even just to answer “no, your honors” to all allegations)
– unlawful raids/searches done by law-enforcement agents to private (but known anti-arroyo individuals) properties (to preempt other individuals from stimulating anti-arroyo sentiments or obtaining evidences unfavorable to the arroyo administration)

– GMA’s declaration of nonsense holidays (to preempt rallies/strikes and to preempt pro-impeachment congressmen to gather together the much-sought after 79 signatures)
– Marcoleta’s endorsement of the Lozano impeachment complaint (before a substantial complaint could be mounted by the opposition)
– administration allies’ “kill-the-impeachment” stance (before GMA will face UN officials, meeting them straight-faced and unblemished)
– national security advisory/warning of possible “terror” attacks (terrorizing in effect would-be protesters before they could amass)
– lawmen’s “disperse-while-few” attitude towards rallyists/strikers (before a full-blown People Power will develop)

i’m not saying foresight is better than hindsight…but considering GMA’s wins in the aforementioned “battles” we should certainly need a heightened vigilance to what GMA and her cohorts are staging. anticipation of GMA’s moves may mean a big difference in this war.

we should likewise encourage our truth-seeker leaders to continue our fight despite the odds. it’s an uphill climb towards the TRUTH…so steep but we shouldn’t let go…for if we do, even just slacken our grip, we will surely die. as the saying goes “when the going gets tough…”

Come to think of it, the majority Tongreesmen who killed the impeachment is just trying the patience of the people, they may even want GMA out thru extrajuditial process….they now think na wala namang lalabas na sa kalye?????

‘The Caving Roof’

At every ordeal is indeed a problem, mine is really simple. Either we sink or ourselves undergo mental dissection by shrinks, but yes, I smell stench but does it always have to be bad odor from a dead meat? Ulterior motives can certainly be taxing at times; in fact, simple comprehension is a problem in this country, and am I fidgety dead afraid? Are you guys kidding? I’m from Mindanao and I’m scared as hell!

Ulterior motives may it be Edgar Allan Poe’s or of FPJ is a foregone persona, but their beautiful poetry remain to me the best of things yet to grace our overburdening country, hungry really hungry and getting hungrier by the day. Politics as we see them present day remain same as decades back, bunch of cheaters, graft ridden, corrupt and by golly, nobody admits to any thing except may be few adulterous behavior here and there, man or woman, love kids…etc. Well, good for PGMA admitting to a problem and asks for apologies, I wholeheartedly accept! PGMA admits to a problem and indeed, I can say we can now find resolutions to it and come up with perhaps something viable for solution.

For my part, the Peace Process with the underground insurgencies are to me the most important event yet to materialize after decades of serious skirmishing, people die as a result, and because of it they die by the hundreds. Would you like me to email to you guys the stench from dead bodies? I see no ulterior motives than a Marxist agenda wanting to subvert our nation into their brand of mayhem. Make an issue of what may be trivialities like the on-going political circus; withdraw from the talks because of Garcillano?

The Peace Process is the goose that lay the gold eggs, if successful; we can have the gold eggs to pay up our needs and perhaps, our debts. What the Marxist agenda would like by their withdrawal from the talks is I would suspect to be an agenda of a protracted people war; a mayhem that may put our nation into a scenario of conflict -never-ending killings until they succeed with what they may be wanting, otherwise, let them explain why.

Whose ulterior motive is it?

THE MURDER OF THE IMPEACHMENT COMPLAINT
WILL HAUNT GMA OUT OF MALACAÑANG

In a show of force and complete contempt against the sentiments of the Filipino people the administration-controlled Committee on Justice thrashed the amended complaint filed by the minority legislators arguing that it was a separate complaint. Three hours later, they proceeded to junk the Lozano version virtually killing all the impeachment complaints. Thus, last night, the majority bloc in the House of Representatives buried the truth about the allegations of corruption and cheating against Gloria Macapagal-Arroyo.

We retched in utter disgust against this murderous act of suppressing the truth. How can they dismiss the fact that Mrs. Arroyo tried to influence the outcome of last year’s elections when she herself admitted that she called an election official? We all know that it was Garcillano whom she talked to over the phone. We all heard her saying the words “yung dagdag, yung dagdag.”

We are appalled by the brazen use of power by the Arroyo administration in perverting this democratic process enshrined in our Constitution. We certainly question the statement of Malacañang that it did not to try influence the outcome of the hearing when Presidential Adviser Gabriel Claudio was seen inside the halls of Congress huddling with Speaker Jose De Venecia and Majority Floor Leader Prospero Nograles yesterday afternoon. Other Palace lieutenants were also sighted in Congress such PCGG Chair Camilo Sabio. The Palace obviously used all its powers to subvert the truth.

We condemn the pro-administration’s railroading of the impeachment process. It was an overkill. Clearly, the rule of law, a phrase they regularly invoke, was not observed in the last two days when they tried to muzzle the truth that their patron, Mrs. Arroyo, was elected into office under very dubious circumstances.

We call on the minority legislators to remain courageous and steadfast against pressures from an illegal and immoral regime. We also appeal to other decent and principled lawmakers to sign the amended impeachment complaint so that it can be automatically transmitted to the Senate.

We also urge the Filipino people to continue to hold on to their dreams of a better and honest government by being vigilant. Let us all go to the House of Representatives on Monday, September 05, and show this administration that we are aghast by the slaying of truth. Yes, the impeachment process might be dead at this stage but we believe that the dead always has a way of haunting us back. And it will haunt Mrs. Arroyo out of the Palace soon.

marami nang vigilant na mga filipino na nagmamatyag sa mga kasalukuyang pangyayari sa pilipinas.. kahit saan ka pumunta sa palengke, sa opisina, sa school, sa kalye sa mga malls ay aware sa grabeng nangyari sa pagyurak ng mga majority tongressmen at supreme court sa mamayang filipino. sobra ng pahirap. hinde na kami makakapayag. kaya nakikiisa kami sa panawagan na makiisa at lumahok sa rally, pagsulat (blog) dito sa internet. makiisa din tayo sa lunes sa kongreso. aabangan namin ang impeachment. good luck to all pro impeachment congressmen! kaya nyo yan. ang buong pilipinas ay kampi sainyo. puede na segurong tigilan ang pagpapaliwanag, pangangatwiran, pagmumura at pagbadya ng matinding galit. sapat na ang panahong iniukol sa pangunawang makatao sa mga demonyo ng ating lipunan.

kung gusto ninyo magbasa ang mga nagwalang hiya sa Filipino at sa Bayan, sa mga sinasabi dito ay simulan na nating talakayin ang ating gagawin parusa sa kanila. kung papaano ibabangon ang ginahasang bayan. Yang na lang ang isipin at isulat. lalong maraming klaseng parusa, lalong matindi at epektibo, lalong dadami sa kanila ang magbabasa, at matatakot sa Diyos. Hindi na magtatawa ang mga yan pag may sinampol na ang bayan.

I absolutely agree with you. Kung naiinis ako kay GMA mas naiinis ako sa mga opposition. Ayan ang napala nila kc naman too much grandstanding eh. Too much media exposure ayan tuloy talo ang impeachment. Daldal kc ng daldal at reklamo ng reklamo sa media. Naghahanap ng mapagbibintangan sa kapalpakan nila. I don’t understand bakit naunahan pa sila ni Atty. Lozano sa pagfile ng impeachment. Nasa kanila na yung tape before di ba. Akala kc ng opposition madadaan lagi sa rally-rally eh. Ayan sa kabagalan nilang kumilos nagulangan sila ng administrasyon. Tapos ngayon sinisisi yung administrasyon… Hmmm. kainis. Mali talaga ang tactika ng oposisyon. Ngayon naman inuugnay si PGMA sa kidnapping, baka makuryente na naman kayo jan. Baka pag wala na kayong makitang ikaso kay PGMA pati yung pagkamatay ni Rizal o Ninoy sabihin ninyo kasabwat din siya.
Daldal kc ng daldal eh, daig ng taong maagap ang taong masipag ok. Tama na muna yung press release, malayo pa ang eleksyon, puro grandstanding ang ginagawa ninyo eh. Try other tactics kc wala ng mangyayari sa strategy ninyo. Matatalino pa naman kayo kaso magugulang ang nasa administrasyon kaya tuloy di kayo makaporma. Change tactics ok. Hindi ninyo makukuha yan sa pagmamakaawa sa mga maka-administrasyon na congressman, pinagtatawanan lang kayo nila. Hindi ko alam kung paano mapapatalsik talaga si PGMA masyado siyang maagap sa mga sitwasyon. Goodluck nalang sa opposition, pls. tama na yung grandstanding, walkout and too much media exposure and press release, do your job…..

Mga Kaibigan kaya nga sila naunahan ni Atty. Lozano ay dahil magaling si Gloria. Sinabi na ni D. Soliman na si Pandak ang pasimuno at pakawala lang si Atty.Lozano. Lahat ng kadayaan ay alam ni PANDAK gawin. Huwag ninyo sisihin ang mga batang pro-impeach dahil hindi pa sila sanay at ang alam nila ay ibunyad ang mga kamalihan at para malaman natin. Hindi ko sila sinisisi at dahil hindi sila mandaraya katulad ni PANDAK. Alam naman natin na mapapel itong Atty. Lozano at balimbing. Mahusay talaga si Gloriang ganid ano. Lahat ng mga kadayaan ay alam gawin para lang hindi maalis sa puwesto.

Since the impeachment process has been reduced into a NUMBERS game, it is ridiculous to think that the rule LAW prevailed. It’s just plain old POLITICS. Politics as defined by Bill Moyers, Poli (many) tics (blood sucking insects).
