Lozano complaint ‘sufficient in form’
SANS members from the pro-impeachment side who yesterday walked out of what they call a “sham” impeachment proceeding, the House justice committee voted 46-0, with one abstention, to declare the original Lozano impeachment complaint as being sufficient in form. The committee then swiftly proceeded to deliberate on the matter of its sufficiency in substance in an unprecedented marathon hearing today.
As of this writing, five members have already delivered their speeches, four invariably claiming that the Lozano complaint is “grossly insufficient in substance,” “totally bereft of substance,” “piggybacking on a disguised electoral protest,” and “predicated on illegally acquired evidence (Garci tapes).”
The vote on sufficiency in form followed the earlier affirmation by the same administration congressmen that the Lozano complaint barred the other two complaints — the one filed by lawyer Jose Rizaldo Lopez and the amended Lozano complaint initially endorsed by 41 congressmen from the minority and party-list groups — by virtue of the Constitutional one-year bar on the initiation of more than one impeachment proceeding against an impeachable official.
(A clear reading of the Constitution and the Supreme Court ruling on the Francisco case that clarified the said provision states that an impeachment proceeding is deemed initiated with the filing and referral of a verified complaint to the justice committee. What impeachment endorsers and constitutional expert Fr. Joaquin Bernas S.J. have been pointing out is that all three complaints, having been simultaneously referred to the committee, can be consolidated in one proceeding.)
There was actually no need for any debate at all as the administration congressmen required no convincing about their already-held position and how they would vote.
No amount of arguing by the likes of Reps. Teodoro Locsin Jr. and Antonino Roman, who were left to provide a contrary view in the absence of their pro-impeachment colleagues, could have swayed them either.
Locsin maintained that the three complaints are contemporaneous of each other. “The sequence in which they came in does not count because they are all valid with respect to time,” he said.
And as Roman added, all the legal calisthenics were useless because the Francisco ruling does not apply given that the complaints were referred on the same day, which put them all in equal footing.
The deliberations on form sufficiency were even more a breeze, with only Reps. Edcel Lagman and Luis Villafuerte taking turns justifying to their administration colleagues that the Lozano complaint was properly verified.
Lagman said that Lozano’s complaint, being cast in an affidavit form, is “an expanded verification” and is coupled with a jurat. A jurat is that “part of an affidavit in which the officer certifies that the instrument was sworn to before him… It is not a part of a pleading but merely evidences the fact that the affidavit was properly made.”
“Besides, Lozano as the complainant is a lawyer,” Lagman said. There is an opinion that says if the complainant is a lawyer, verification is not necessary anymore as his signature under his lawyer’s oath is sufficient.”
Whose opinion it was, Lagman did not mention. But some lawyers are saying that it is a legal fiction, Lagman’s own invention.
Lawyers of the impeachment legal team also would like to make a distinction between a jurat and a proper verification, which, according to case law, is “intended to assure that the allegations in the pleading have been prepared in good faith or are true and correct, not mere speculations…”
The rules of procedure define the form of the verification to be done, as expressed in the following:
We, after being sworn in accordance with law, depose and state. That we are the complainants in the above-entitled complaint/resolution of impeachment; that we have caused the said complaint/resolution to be prepared and have read the contents thereof; and that the allegations therein are true of our own knowledge and belief on the basis of our reading and appreciation of documents and other records pertinent thereto…
In contrast, the Lozano complaint, including its supplemental complaints, only carried a jurat in this form:
…SUBSCRIBED AND SWORN to before me this 27th day of June 2005, in Quezon City. I certify that I personally examined the affiant who understood and voluntarily executed his affidavit…
But without the minority to point this out, this issue went largely uncontested, as evidenced by the overwhelming vote it got this evening.

its not the military participation that’s preventing an edsa rally… its the church as promulgated by pope benedict and prohibits the church participation in politics – edsa 1 was staged via cardinal sin, as well as edsa 2.
no military then at the start and we don’t care. eventually they’ll support.
this time there will be no assurance that the military will join given that today military and malacanan has stronger relationship than what history would tell us. and we should not care. military is as corrupt as hell as malacanan.
where is the church when you need them? after all this is a moral issue… not politics.

what would be a good comment is that they cannot meddle in the affairs of congress.
this only mean that malacanan have implied that they have all the capability to interfere or is already interferring but not in the open, ofcourse.

This is the biggest mistake that pro-administration congressmen has done to our country. Hindi natin dapat ipinagkatiwala sa mga demonyong ito ang kinabukasan ng ating bansa. Walang nakikinabang sa mga hayop na ito maliban kay GMA. Mga manhid at sakim. Mga walang utang na loob sa mga kababayang nagluklok(?) sa kanila sa kapangyarihan. Mga kampon ni Satanas ang nakaluklok sa Malakanyang kaya huwag na tayong umasa pa na uunlad ang ating bansa. Nagpupuyos sa galit ang aking damdamin sa tuwing maririnig at makikita ang ko ang katulad ni Villafuerte, Bunye, Ermita, Gonzales, pati si Claudio, Tiglao, Makalintal, Lumibao, etc. na puro kasinungalingan ang lumalabas sa bibig. Kilalanin ninyong mabuti ang mga tauhang ito na naghahasik ng kasinungalingan, panlilinlang at sariling kapakanan lamang ang iniisip. Sinalaula nila ang kasagraduhan ng institusyon na dapat sana’y sambayanang Filipino ang pinahahalagahan. Mga salot sila sa lipunan. Bahala na ang Diyos sa kanila. Lintik lang ang walang ganti.

Iyong lang ang pagasa niyang maging leader, kasi maski sa pagkasenador hindi siya mananalo. It’s easier to buy the Congressmen than millions of Pilipinos. Sila sila na lang ang mangungurakot sa Gobiyerno tapos pababayaran sa mga tao ang mga winaldas nial. EVAT pambayad sa winaldas si Gloria.

GMA should award Lozano by appointing him as Ombudsman. Give Markoleta a new car para hindi na siya magraklamo na ang nabili niya ay lemon. Nagrereklamo pa siya eh kurakot lang naman niya iyon. Sino naman kaya ang magiimpeach sa kaniya next year and the succeeding years. Di panay nalang regalo si GMA sa mga buwaya para hindi siya maimpeach. God bless the Philippines.

That’s a spoiled brat’s way out. Parang yung mga congressman na nag walk-out. Meron pa silang responsibilidad nag walk out na sila. Eh kung naghagilap na lang kaya sila ng boto para mapasa na ang impeachment? Kung 2nd vote wala pa din – dun sana sila nag walkout at mas effective pa sa mata ng taongbayan – at least they tried. as it is, premature yung ginawa nila.
Besides, hindi pa tapos ang lahat, may plenary pa. Kung ako ang opsisyon, walang matutulog na kongresista ngayong gabi…bubulabugin ko silang lahat para makuha ang 6 na lang na kelangan. And if that doesn’t work, may next year pa. Siguro naman by that time, alam na nila gagawin nila para matuloy na ang impeacment…
Isipin mo nalang, anong kalalabasan ng street protest sa puntong ito? Democratic na nga ang gobyerno at hindi na diktadura pero nandyan pa din ang mga komunista….ito na ang demokrasya. Diba’t ang kulit na natin kung street protest lang alam nating gawin? May shortcomings lahat ng forms of government pero uulitin ko HINDI PA HULI ANG LAHAT, may proceso yan. twing haharap ba tayo sa shortcomings ng demokrasya, magtatampururot na lang ang bayan?? Hindi gawain ng matinong taong nasa wastong edad yon….mag-isip muna tayo…lulusong ka ba sa baha kasama ng maliliit mong mga anak na hindi mo alam ang lalim ng tubig?
kung noon pa, impeachment ang pinag-uusapan natin at hindi “resign” na alam naman natin hindi gagawin ni GMA, nasa mas maganda tayong katayuan ngayon. Kasalanan din natin ito….dapat kinulit natin ang oposisyon. pero sa huli, ang responsibilidad ay hindi lamang nasa iilan sa tin….

Had we only followed the rule of law during the impeachment of Pareng Erap we wouldn’t be in this mess.
I am not saying he is innocent of the charges, Had the then Speaker Villar did not railroaded the process, then EDSA 2 wouldn’t had happened, and GMA won’t need to cheat to win the 2004 Elections, she’s a shoo-in. The constitution was violated back then, how can people simply follow the rule of law now?
