THE Senate passed a resolution yesterday condemning actions taken by the government following the issuance of Proclamation 1017.

The senators questioned what they called "alarming acts" carried out by government authorities, like the warantless arrests of opposition leaders like Crispin Beltran and certain military officials, the exercise of control over print media, veiled threats against broadcast networks, and even the 6 p.m. curfew imposed on the Malacanang Press Corps.

"These acts carried out by the government pursuant to Proclamation 1017 on its face contravene the fundamental guarantees of the Constitution particularly the basic civil liberties enshrined therein and deserve outright condemnation," the resolution stated.

It added that General Order No. 5, which grants authority to the Armed Forces of the Philippines and the Philippine National Police to prevent and suppress violence and terrorism, "open(s) boundless opportunities for abuse and violation of fundamental human rights."

The resolution was filed by senators Franklin Drilon, Francis Pangilinan, Mar Roxas, Rodolfo Biazon and Pia Cayetano.

Arroyo, you’re running out of time. Your enemies are gaining momentum and getting bolder. Declare Martial Law, get rid of them, and get on with your economic reforms…cleanse the Philippines. This is a once in a lifetime opportunity for you to prove that your intentions are good. The Senate hall is no longer home to the likes of Pelaez, Diokno, Aquino, Salonga…..instead we have actors, wife of a deposed drunk, and wanna be legislators using their last names to have a feared license plate.

It seems like people are really provoking GMA to declare Martial Law. As for several times they’ve clarified the proclamation as a state of emergency and not martial law. I think this is another mind-conditioning tactic so that the public who had a trauma from Makoy think that she can be likened to the former dictator. These people are just aggravating the situation.

From the investigation that the AFP conducted, they’ve come to a conclusion that there’s a destabilization plot going on. The leftist, the rightist and some political parties are conniving on this plan.

You know GMA’s actions like EO464, CPR and state emergency is a sign that she is getting more desperate ,bolder and more vicious…. I just hope that if she comes down she doesnt drag us all to the abyss……

What I am afraid of is that some people or elements in the military might run out of peaceful options and will be forced to take a more violent step…. there are people who will not take these abuses sitting down…..we dont want Filipinos hurting fellow Filipinos because of one woman…..

timtim2, i dont know which constitution u r referring to with your quote, but the 1987 Philippine Constitution contains no such provision. Sec 18 of Article 7 which u refer to states:

” Section 18. The President shall be the Commander-in-Chief of all armed forces of the Philippines and whenever it becomes necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion or rebellion. In case of invasion or rebellion, when the public safety requires it, he may, for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law. Within forty-eight hours from the proclamation of martial law or the suspension of the privilege of the writ of habeas corpus, the President shall submit a report in person or in writing to the Congress. The Congress, voting jointly, by a vote of at least a majority of all its Members in regular or special session, may revoke such proclamation or suspension, which revocation shall not be set aside by the President. Upon the initiative of the President, the Congress may, in the same manner, extend such proclamation or suspension for a period to be determined by the Congress, if the invasion or rebellion shall persist and public safety requires it.”

Im afraid ur interpretation of the constitution is quite unplaced. Do you work with a Malacanang PR Firm? =)

yup the resolution will help a lot to protect the democracy…though i have not seen the documents i believe the intention of the resolution is only to question the motive of the proclamation because it go against the democratic form of government we have…democracy has two opposing powers, one is the opposition w/c always scrutinize or fiscalize the other one w/c is the majority ruling party…and how can we balance this two powers harmoniously? thru supreme court (w/c shld be always impartial to both of them) and of course the public, uniformed men, and the media…we have a very very nice form of govt…imagine it involves anyone of us ‘basta pilipino ka’…kasi yun ang impurtanti!…kaya lang parang sa nakikita’t nababasa ko sa mga balita…parang iba ang dating nitong 1017…
tanong ko lang…anong bayan ka ba? kasi nagtatanong ka kung it will help sa bayan.

yan ang tatlong branches ng government. lawmakers ang senado. protecting the democracy is not their job – that’s the job of the military.

ang resolution na nilabas ng senado ay isang press release lang kumbaga. makakatulong ba ito sa bayan? bakit bawal tanungin ito?

may kaso na sa supreme court. yun ang makakatulong sa bayan..hindi ang resolution dahil, sa uulitin ko, press release lamang ito. pandagdag pogi points.

the media and the public is not part of the very nice form of government of ours… we are part of society. we are citizens of the state but unless you are a government employee,political appointee or an elected official, you are not part of government.

thanks for reminding me of a few branches of the state…hinde naman bawal magtanong at syempre di naman bawal sumagot sa tanong, di ba? kagaya nang sinabi ko, we have a very nice form of govt. w/c is a democratic system. pls allow me to express my thoughts of what i’ve learned during my academic days and i hope i could still explain this dynamic system we have. democratic system is an attainment or realization of a democratic stability and political completeness w/c permits an effective representation of large sectors of the population which addresses their general or common interest of the people and by the people. di ba ang galing…it is a cyclic representation of balance of power…and it means all of us is a part of the govt…sa kaliwa ka man, kanan, gitna, o tagilid…all of us is a part of the govt…and one of the common interest of the filipinos is the universal freedom…for freedom then refers to whether a person can do what he chooses, not to the choosing itself; it refers to the freedom of the action, not to the choice of act. A person’s will could be enslaved by the passions, chained to Freudian complexes, bound to the body’s needs, limited by heredity, and necessitated by environmental causes, and yet by this meaning of freedom, he could be totally free to do that which is determined. For me the virtue of this meaning is in enabling both necessity and freedom to coexist; it permits a belief both in the most complete causal explanations of human behavior and in our freedom; it favors an ethical reliance on moral deterrence without necessitating moral responsibility. It violates common sense to call free a person who is determined in his course like an object thrown through the air and following its trajectory without opposition. “freedom to do without restriction” means POWER , an ability, restricted to the person, and not a freedom of the will. This is the dynamics of a democratic form of government, no one is above the law, everyone is equal…hope you like it…

Thanks Doblezata for clarifying the issue timtim2 posted, I was wondering where she got her information.

The National State of Emergency is nothing but a pretext of martial law. We are not provoking GMA, we are merely stating a fact. The powers she is using now is not part of the State of Emergency. As they themselves said, the declaration is merely a statement of fact but it does not include the powers she is exercising now.

With this declaration and with all her moves, she has no other option but to quell all her opposition. I only hope that she be removed from malacanang sooner than later. I wonder how soon she will join the previous head of NBI? Didn’t he just croak due to stress? Will God be merciful to us and invite Arroyo sooner? Didn’t she keep stating that God speaks to her? Maybe God will be merciful and remove Arroyo from this world.

Sasakay na naman ang mga minamahal na senador natin sa isyu ng PP1017 instead of just leaving it to the Supreme Court to rule on its constitutionality.

If we may remember, the Supreme Court ruled in favor of the legality of GMA’s declaration of a state of rebellion in 2003, stating that she “was merely exercising a wedding of her chief executive and commander-in-chief powers” and that there was “no indication that the President had exercised judicial and legislative powers.”

In regard to PP1017, there is no need for the Senate to interfere in what could very well be settled by the Supreme Court soon. Tama si MitaMs, pang-press release lang yan. Pandagdag pogi points.

What’s up with “Secretary” Gonzales? Every time I see him being interviewed in his office, you see piles and piles of papers in front of him and behind him. There are even books over filing folders, which are then covered by more folders. Someone needs to take up a collection to buy him filing cabinets, wall shelves, standing shelves and perhaps an IN tray, an OUT tray and a very tall “BEEN ON MY DESK SINCE I TOOK OFFICE” tray. One wonders whether he has looked at these documents at all. Does he think that all this clutter makes us beleive that he is very busy?
