TWO military officers today told the Senate defense committee that the Commission on Elections, aided by other top military officials, maneuvered to “slacken” security in Lanao del Sur, leaving the door open to massive cheating in the province in the May 10, 2004 elections.

Brig. Gen. Francisco Gudani said he was relieved of his post as Marine brigade commander of Task Force Ranao without justification on May 12, 2004, two days after the elections, and just as the counting of ballots and canvassing of election returns was getting underway. His name was mentioned in a portion of the Hello,Garci tape.

The Senate hearing comes at a time when it seemed the Hello, Garci issue had died down and President Arroyo is going on the offensive, suppressing rallies and taking punitive action against government officials perceived to have turned against her.

Gudani and his subordinate, Lt. Col. Alex Balutan, defied an order from Malacañang preventing military officers from appearing at today’s hearing.

At 1 a.m. today, Gudani said he got word from the AFP Chief of Staff Gen. Generoso Senga, coursed through the superintendent of the Philippine Military Academy, not to appear at the Senate. Gudani is currently the assistant superintendent of the PMA.

Part of the order from the AFP hierarchy said: “Per instruction of President Gloria Macapagal Arroyo, no officer of the AFP shall appear before the Senate hearing without her approval.”

Balutan told the Senate that Gudani’s relief could not be explained to the soldiers in the field, especially since the officer sent to replace him was someone not from the same service and rank.

Gudani’s replacement was a certain Col. Pirino of the Philippine Army (believed to Col. Gominto Pirino of the 5th Infantry Brigade) who, according to Balutan, told the brigade “to support the administration” and “luwagan namin ang security sa canvassing area (loosen security in the canvassing area).”

Balutan said his commander was relieved “for no apparent reason, for being apolitical, for being impartial.”

In his opening statement at the Senate, Gudani said “for the past few months, my conscience has bothered me” and that he had decided to tell the truth, because it was what the PMA honor code compelled him to do.

“I am here as assistant superintendent of the PMA where we teach the cadets the honor code which says that a cadet does not cheat, does not steal, and does not lie, nor does he tolerate these…I would not have the honor to face the cadets if I didn’t’ tell the truth,” Gudani said.

Gudani also said he was appearing before the Senate in behalf of the Military Christian Fellowship, an organization of born-again Christian soldiers, of which Gudani is president.

In his testimony, Gudani also said that on May 12, he was summoned to Manila by his superior, Marine Commandant Gen. Emmanuel Teodocio, and Navy Flag Officer In Command (FOIC) Admiral Ernesto de Leon. Gudani said he was told to take a break — play golf, go to Boracay — which to him was an “incomprehensible and illogical order” since his presence in the field was needed at that crucial period in the election process.

Gudani returned to Lanao on May 20, much to the chagrin of Garcillano and a certain Gene, believed to be a political operator, as shown by this portion of the Hello, Garci conversation:

Gene: Boss, nakatanggap ako ng certification ngayon dito galing sa mga bata natin sa Lanao, nag failure na naman pala dahil kay Gudani.

Garcillano: Oo nga eh.

Gene: Putang-ina, sino ba yang Gudani, bakit ganun yun?

Garcillano: Yun ang pinaalis ko.

Gene: Oo nga, ba’t andudoon na naman, papaano ‘to?

Garcillano: Oo nga, bumalik na naman. Kaya nga ayaw makialam si First Gentleman dyan. Sabi ko nga, pinasabihan ko nga kay Ruben Reyes na paalisin na nyo yan.

Gene: Putang-ina, tarantado talaga to.

Garcillano: Oo, pinaalis ko yan eh. Pero after three days after elections, bumalik man dyan. And nag (garbled) dyan si Col. Quirino Pirino thru Gen. Esperon at tsaka si Gen. Kyamko.

Gene: Eh ano ba gagawin ko, gagawan ko pa ba ng memo ‘to o ipapareschedule, papaano, gagawa ako ng memo sa en banc?

Garcillano: Ipa-reschedule natin.

Gene: Gagawa ako ng ano ha.

Garcillano: Oo para sa commission en banc.

Gudani’s name was mentioned by Garcillano in a conversation he had with President Arroyo on May 28. In that call, Garcillano told the President Gudani was siding with the opposition:

Garcillano: Ano ma’am?

GMA: The FPJ camp raw will file a case raw against the Board of Canvassers and the military in Marawi?

Garcillano: Hindi naman ho siguro nila maa-ano yung ating Board of Canvassers, pero ang military,kasi si Gudani, sa kanila si Gudani. I do not know why they will file.

GMA: Oo, oo.

Garcillano: Sa kanila si Gudani ma’am. In fact that’s why we have, I have to work with Gen. Esperon and Gen. Kyamko na at that time, pinalitan namin si Gudani for a while. Kaya kwan, pero bakit nila file-filan yang mga military na sa kanila lahat. Halos ayaw na nga mag-give way sa aming mga tao.

GMA: Oo, meron silang pina … (line cut)

Gudani said the suspicions were unfounded. He surmised that they were associating him with the camp of former presidential candidate Fernando Poe Jr. because he happened to sit beside Poe, opposition leader Ernesto Maceda and Poe’s running mate Loren Legarda during a plane ride from Mindanao to Manila.

Gudani also testified:

  • That it was Garcillano who was giving orders to Provincial Elections Supervisor Rey Sumalipao, although Garcillano was officially the commissioner in charge of Southern Tagalog and Bicol.
  • That one or two weeks before the elections, Sumalipao revised plans made well in advance of the elections, changing policies, replacing board of election inspectors, and causing much confusion. Gudani said the moves were made on orders of Garcillano who signed the memos implementing the changes.
  • That he had information that First Gentleman Mike Arroyo made two trips to Mindanao via a private helicopter to deliver cartons of cash. Gudani said an informant told him Arroyo carried around P250 million in each of those two trips. The helicopter landed “somewhere in Iligan.” Gudani said he and his informant knew the person who supposedly helped divide the cash and tie them up in bundles.

Asked whether they got orders, received bribes or were persuaded or influenced by any one to manipulate the elections, the two officers admitted receiving bribe offers from local candidates.

Gudani said he was offered P1.2 million by a mayoralty candidate “to protect his votes.” Gudani said, “I politely declined because the Marines don’t do that.”

Balutan was also offered P300,000 also by a mayoralty candidate. He said he reported the offer to his commandant, and said he did not need to protect anyone’s votes because he was already doing that as part of his job.

At the start of the hearing, committee chairman Rodolfo Biazon agreed to the suggestion of Sen. Panfilo Lacson to place both officers “under the legal custody” of the Senate, given the sensitive nature of their testimony, and to prevent reprisal from their superiors who might charge them for going on AWOL.

Malacanang has already relieved these 2 officers from their respective commands. according to Gen.Senga they will even be subjected to genral Court martial proceedings. Is this the reward for telling the TRUTH. Aren’t we supposed to be grateful that there are still men in uniform who are loyal to COUNTRY over loyalty to individual. These officers showed that they love their country above all else. My prayers that there will be more officers like Gen. Gudani and Lt. Col.Balutan. MABUHAY SINA GEN. GUDANI AND LT. COL. BALUTAN.

The President is also the commander in chief di po ba? Natural lang siguro na kung may mga concerns o grievances ang military members, dapat lang siguro galangin ang kanilang commander. Kung may reklamo sila o gusto iparating, di po ba tama lang na sa commander muna bago iba ipagbigay alam? Ganun ang buhay ng sundalo kahit sa ibang bansa pa, naghihintay ng utos ng commander. Kung di nila kaya, dapat magresign sila. Ganun po kasi pagkakaintindi ko.

Sa palagay ko, Timtim2, dumating na sila sa puntong ano ba ang mas mahalaga, ang chain of command na sinasabi nyo o yung kanyang pagka-PMAer? Ibig sabihin nung una ay itatago niya ang nalalaman niya tungkol sa dayaan sa nagdaang eleksyon dahil sigurado ayaw ng commander-in-chief na mabuking ang pinaggagawa nila noon. Salungat ito sa pangalawang punto na kailangan isabuhay niya ang code of honor, ang hindi pagsinungaling at ang hindi pagpapayag na pabayaan ang kasinungalingan na umiral. Malinaw naman na pinili nung dalawang tunay na sundalo ang pangalawang punto. Kaya tayo nagbubunyi dahil patunay ito na may mga matataas pa pala tayong mga opisyal na nagpapahalaga sa kanilang propesyunalismo at integridad, ready to face possible sanctions from higher ups who kowtow to the CIC, firm and resolute on his principles para lang mailalabas ang katotohanan. Col.Balutan siguro yung mga makabayan nating mga sundalo dapat kumilos na para patalsikin na ang pamilyang nagpapahirap sa bayan.Kailangan po tulungan na ng mga sundalo ang masa,wag kayong parang ROBOT na sunod ng sunod kahit “unlawful orders” ang utos.Isipin po natin ang kapakanan at kinabukasan ng bayan,Dont follow the chain of command if it is for the sake of the people and country,But instead defy GMA and bring her in court for her crimes commited,PWEDE BA SIYA MA FIRING SQUAD GAMIT AY PILLETS?

Timtim, di lang isa ang nagre-react sa punto mo tungkol sa Chain of Command. Sama mo na ako. Ang Chain of Command nasusunod lang kung honorable at truthful ang Commander in Chief. Pero pinagloloko na tayo ng Commander in Chief, hindi na Chain of Command ang issue, Change of Command na!

I admire you for being calm in bringing up the issue in this blog. Few people can maintain such kid of equanimity in the face of adversity. Perhaps, God is sending you a message to either withdraw and reflect hard on this brewing crisis or make a heroic switchover. It is hard to defend the indefensible. Yumng talagang due for checkmate, ma-che-checkmate yan for sure. I know it because in the past two EDSAs, I was on the “losing” side trying to shout at the top of my voice, almost to naught, that my pet did it right.

Iwanan mo na yang “158 mentality” mo TimTim (remember the infamous number 158, the number of cover-up?). Kung noong panahon ng martial law eh pina-uso ni Macoy “Sa ikau-unlad ng bayan, disiplina ang kailangan”, siguro marapat lang na ngayon sabihin naman natin: “Sa ikau-unlad ng bayan, KATOTOHANAN AT KATAPATAN ANG KAILANGAN”, dahil nga wala si GMA niyan. Pati institusyong dapat ay matino, binababoy para sa ambisyon ng ganid sa kapangyarihan. Ang tunay na Chain of Command, taumbayan ang nasa ibabaw. Si Gloria ay subordinate ng mamamayan, di po ba mga mahal nating kawal ng bayan? Kung ang utos ng mamamayan ay patalsikin ang abusado, sinungaling, mandaraya, at magnanakaw, dapat sumunod ang mga tunay na Kawal ng Sambayanang Pilipino.

Di lang si BG Gudani at LTC Balutan ang may pusong makadiyos, makatao, at makabayan sa AFP at PNP, marami pang iba. Sa ngayon ipagbunyi natin ang kabayanihan ng dalawang kawal na ito. Mga tunay na lalaki at kagalang-galang na mga alagad.

Sa mga ganitong pagkakataon sa ating kasaysayan, maraming mga Gudani at Balutan ang tatayo upang ipaglaban ang kanyang bayang mahal. I hope this will not start a civil war. If only soldiers would examine their conscience and see the light. Rumors of rumblings in the military should not be taken lightly. I still trust that the men in uniform will once more rise to the occassion and show their love for country and the protectors of the people. This EO 464 is a form of censorship that curtails transparency and public disclosure. GMA must keep in mind that all public officials are answerable to the people.

What people?? Most of us are fence sitters naman regarding this matter.. That’s why i think gloria will get away with it.. Crime does pay in this country.. Its been a proven formula time and time again.. That’s why we have Mayors Governors Congressmen who drivew around in luxurious cars provided by our taxpayers money.. we paid for it.. we paid for the gas that runs it.. we payed for their houses.. their lifestyle.. And all that they can show for it is a poorly run government at best.. At worse you cant even figure out how they won their respective seats in the first place.. I mean have you ever seen them during the house inquiry and during the impeachment case?? Most of them dont even make sense!!..those who do naman walang logic.. blind loyalty to a faulty president.. “kaya hirap maging optimistic pag nakikita mo yung mga ganun??” cant you blame then why most of us want to seek greener pastures abroad?? Kya natitira nalang po rito sa pinas eh yung mga tanga nagtatanga bingi nagbibingi.. mga kriminal mga sinungaling at yung mga mahirap.. so you tell me.. is there any hope left for us?? for us a people who tolerate a president who knowingly and blatantly lied to us?? and choose not to do anything about it?? i dont think so..

Si Timtim2 ay may katwiran sa pagunawa niya sa kahulugan ng chain of command ng military. Ang direct order sa military ay hindi kinukwestyon, right or wrong, upang mapangalagaan ang lubusang pagsunod nito, under pain of court martial, lalo pa man na ang order ay hindi lang galing mula sa Chief of Staff kundi sa Commander in Chief pa.

Gudani is a false hero in my book. Claiming he’s willing to die for love of country, where was he when his countriy needed him to correct a grievous wrong? Why didn’t he do the job he was assigned to by making arrests when he discovered election frauds were being committed? Why didn’t he speak up when the canvassing of ballots was being undertaken in Congress in the midst of vigorous claims of election fraud? Why did he keep his silence during the impeachment? Those were moments that would have changed the course of justice had he opened his mouth because those were perfect moments that could’ve hit the people with so much impact. Ngayon tanggap na ng maraming tao na may dayaan ngang naganap pero sawa na rin ang tao kung kaya’t wala na ang interest.

Magsasalita din pala bakit nagantay pa ng sobrang isang tao? Parang naging defensive reaction na lang ang dating ni Gudani. Bakit? moro mora na talaga ito, as long as Gloria is there, wala nang tama, theres is no absolute right and wrong, everything will be always put into question.

It would have been a perfect timing, and the last opportunity too, na magsalita na si Gudani immediately after the impeachment sapagkat alam na ng lahat, bago pa man matapos ang impeachment, na hindi papasa ito. Hindi naman congresista si Gudani para magsalita sa impeachment ngunit ito’y pagkakataon nya na magsalita ng openly sa bayan sa mga nakita daw niyang election fraud. Ngunit hindi nya ginawa ito. Noon palang bakit hindi nya ginampanan ang tungkulin at hindi nya inaresto ang mga nandadaya. A perfect timing sana para isiwalat ang dayaan na sangkot si Garcillano. Hindi nya ginawa ito. Bakit hindi sya nagsalita openly nuong canvassing upang patunayan ang mga claims ng opposition na may dayaan nga. Bakit hindi sya nagsalita nuong nadiscobre ang Garci tapes. Hindi bi ito’y huwaran ng isang nagpapanggap na may prinsipiong tao, pagkatapos sasabihin nyang ginawa nya ito for love of country and truth? Natakot lang syang gisahin sa senado kaya’t napilitang kumanta.

Kung ang hangarin ng marami na magalsa ang people power, ito na marahil ang mga pagkakataong mahikayat nya ang bayan. Hindi ba ito ang hangarin mo rin? Hindi ako ang dapat sisihin sa mga sumbat ko kay Gudani dahil hindi ako ang nagkulang sa iyo kundi si Gudani. GETS MO?

The reason for the EO is to prevent the grandstanding and inuendos that these lawmakers are doing. Tama lang iyon dahil puro dakdak lang naman yung mga iyon tapos pagbotohan na e di naman sila boboto ng for the impeachment, sila din ang mawawalan ngayon nung tinanggalan ng chairmanship yung ibang bumoto ng for e anong ginawa. Ayun nag ngangawa at nag iiyak kaya tumigil na kayo sa kakasigaw ng oust GMA at simulan na nating ibalik ang respeto sa office of the president. tigilan na iyang moro moro sa congress at magsimula na silang magtrabaho pati yung mga rallyista , magsitigil na kayo at nakakasagabal lang kayo sa kalye

gudani might be one of the witnesses of pro impeachment procecutors kaya lang pinatay na nga impeachment kaya di sya nabigyan ng chance. now is the chance sa senate hearing kaya ayun patay si arroyo hahaha! di nya kaya senado. kung ang congress kaya nyang tapalan ng kwarta ibahin nya sila pimentel, osmena, magsaysay, biazon, gordon, madrigal lacson at iba pa.

i agree the mere fact that this guy decided to go against the main crook the big kahuna in this country risking his life.. his family’s life says alot about him.. maybe he has his motives as to why now lang sya naglantad.. this the risks he’s taking now are great.. kaw kaya toro.. would you risk your life the life of your family to stand up against a criminal who has the potential to wipe you n yours off the face of this planet?? gets mo??

the problem here lies not in the merit of the case.. coz i tell you majority of us know she cheated.. the problem lang is that most of us really dont think there’s an alternative to gloria. but herein lies the rub.. the more we get to know this false president ad her policies.. the more we tend to believe that she’s not the right person for the job anyways.. so if its a choice between the devil and the deep blue sea.. hey give em a snorkel now coz im swiming.. heck lotsa people feel that way.. or they wouldnt be taking up nursing in the first place.. When you have doctors who decide to study nursing just to be able to get out of this dang country and its rotten politicians then isnt that a signal that there’s something wrong in said country’s system of government?? When you have a president fresh from the “acquital” she got from a rubber stamp congress continues to commit errors in judgement thru issuance of laws curtailing political freedoms, curtailing the powers of an equal branch in government, entering into contracts which promises us trains we dont need but have to pay nonetheless.. isnt that a signal that din that there’s something wrong with this president??
frankly i have no problem putting this all aside.. as i think most of us in the middle class are doing.. concentrating on eaking out a meager living .. life is hard.. seems that every year its getting harder still..so when you hear bout what these people are doin with our hard earned taxpayers money.. squandering on deals which impact on our lives.. on better yet impact more on those congressmens and government officials lives more than ours.. does’nt it make your blood boil?? are’nt the ones who told us to tighten our belts coz we are in fact a poor soo goin to be bankrupt country.. and yet you see all those brash congressmen in big cars with wang wangs.. fancy clothes.. grandiose houses.. Don’t you people see anything wrong with this picture?? sorry but a government that readilly throws away a million dollars on contracts that don’t develop anything in this country seems a lil bit unsettling to me.. funds that can be used to alleviate the plight of the less fortunate.. give them better living conditions etc etc.. somethings wrong with our picture guys… high time we correct it..

naman no. noon sumunod si gudani sa chain of command sa pagpapalipat sa kanya at kay balutan to “stand down” sa security during the elections. ngayon tama na. gusto na talaga sila patahimikin para hwag patibayin ang alam na nating lahat na si gma ay walang karapatang manatili sa malacanang.

the eo’s purpose is not to prevent grandstatnding but ultimately to slash the oversight functions of congress. that’s a gag order. a lot of people know a lot of illegal and abhorrent details about transactions in gma’s admin. ayaw ng malacanang magsilabasan ang baho nila lalo na sa mga oras na ito na halos lahat ay naniniwalang nandaya si gma. natatakot silang magatungan.

dahilan nila ang nangyari kay norberto gonzales. e kung sinabi ba niya ang nalalaman niya di wala sanang ganito. ang bastus kasi ni gonzales, ininsulto niya tayo sa kanyang lantarang pagsisinungaling. di niya alam kung sino ang nagbayad pero alam niya 3 months bayad na???!!!!! sinong ginago niya? ni hindi niya isinagguni sa kahit na sinong abogado ang kontratang pinirmahan niya?!!! susko!!!! andaming abogado sa gobyerno. it only shows na secret yung kontrata. bakit kamo? dahil kung secret ang contrata secret rin ang makukuhang funds na i-lo-lobby, di ba? kung secret ang funds, kanino ito mapupunta? mismo.

galing nung nagsabi na ang susunod ay character assassination. nagsisilabasan nga sa text ang paninira ng malacanang kay gudani. siguro naghahanap pa sila ng ihahagid nila kay batulan. BUMENTA NA YAN!!! wala nang naniniwala sa ganyang tactic niyo. hello!

at kung talagang atat or may plano rin syang mandaya during the elections, courtesy of FPJ’s camp directive (halimbawa), i doubt naman na hindi mo yan basta-basta mapaalis sa lugar ng assignment nya para lang mag-golf o magpunta sa boracay….

tama ka jn, sinning saint. wala namang direct knowledge si Gudani para mang-aresto. isa pa, what Gudani is pointing out is that the Garci tapes is, in a way, true because he was “pulled out” from the field during the period mentioned in the tape. he is not testifying directly on the rigging that occured but on the veracity of the contents of the tapes.

Penpenpen88, speaking of Marcos, I’d like to draw out your opinion in a friendly discussion, if you agree, why it appears much easier to convince the people to come out and remove a fierce dictator and a movie actor president but not GMA? Let’s have our take on this.

The beginnings of the scenarios were about the same as we are facing today. There is general public discontent. It’s given that on both situations the military’s participation had a hand in deposing both leaders. Given too is that in the Edsa I the military precipitated the revolt and the people came out in support. In Edsa II it was the massive convergence of people that precipitated the revolt and the military came out to side with them.

We have a leader, GMA, who is accused of almost every crime the previous deposed leaders had allegedly committed. GMA has become the most unpopular president, according to surveys. She is hated, villified, unwanted, enough reasons for the people to come out in droves and kick her out. Question. What’s keeping the people out?

Let me start with what I think. I’ve always maintained that the removal of GMA through unconstitutional means can only be successful if done by two elements. It cannot be done successfully with just one without the other. If the military comes out and the people do not it becomes an unsuccessful coup. The people will oppose it and together with loyal govt. military forces there could be a bloody confrontation as what happened in the unsuccessful coup in Dec. 1989. If GMA survives the coup she remains the constitutional leader. The defeated coup leaders may even face execution. If the coup is successful there is no certainty that the people will support it. This Republic goes banana.
No nation respects a banana republic.

On the other hand, the people have not come out in meaningful numbers to join the various calls to bring down GMA. The military establishment refused to come out either, in spite of the open pleadings by retired generals to break the chain of command and withdraw its support of GMA. It has remained steadfast to stay out of politics. Perhaps, the military has indeed reformed and finally recovered their sense of professionalism.

Do you have an opinion why the people in general seem lukewarm to calls for GMA to step down? I realize there are many in this forum who seek GMA’s ouster and I can understand that. I also believe that all share the view that GMA has a lot to answer to the people. I do share that view. I also believe that we all have one objective, however, we seek different paths to achieve that objective. What I’ve seen so far in this forum is a lot of bickerings and senseless unproductive innuendoes. I believe the only way our goals can be achieved is if we resolve the pros and cons of the issues hopefully finding an acceptable way to do the rightful way together. This blog is a great forum for exchange of ideas and opinions, but please let’s all do it in a fair, pleasant and respectful manner. Thanks.
